𝗘𝗺𝗽𝗹𝗼𝘆𝗲𝗲 (𝗪𝟮) 𝗼𝗿 𝗖𝗼𝗻𝘁𝗿𝗮𝗰𝘁𝗼𝗿 (𝟭𝟬𝟵𝟵)? From an ACA perspective, out of the 6 factors in the DOL's Final Rule to determine if an individual is an employee or contractor, Control and Permanence are the main ones to consider. Though all factors must be taken into account. The IRS will always be skeptical and may assume that a certain employer classified a W2 employee as a 1099 to avoid offering coverage.... and rightly so, as this was common practice before the ACA and many employers continued it. Permanence is pretty straight forward to determine, but determining the level of Control is more of a grey area. Imaging a designer you hired to produce your logo. You do have some control over their work, as you will be giving them parameters about the look, feel, deadlines, etc. for the project. Does this level of control make them a W2? The easy answer is "no"... but based on the DOL's newest 6 factor rule to determine this, it may be more difficult to do. However, if you are a Law Office and your bathroom sink breaks, you call a plumber. As a lawyer, you will have minimal to no control over the plumber's work (it may actually be the other way around!), so it is safe to say that, in this case, the plumber is a 1099. We see this mostly in hospitality because of its inherit seasonality and high rates of turnover, such as in restaurants. 🔴 𝗦𝗺𝗮𝗹𝗹𝗲𝗿 𝗲𝗺𝗽𝗹𝗼𝘆𝗲𝗿𝘀 𝘄𝗶𝘁𝗵 𝗵𝗶𝗴𝗵 𝘁𝘂𝗿𝗻𝗼𝘃𝗲𝗿 𝗿𝗮𝘁𝗲𝘀 𝗮𝗿𝗲 𝗲𝘀𝗽𝗲𝗰𝗶𝗮𝗹𝗹𝘆 𝗮𝘁 𝗿𝗶𝘀𝗸! 🔴 For example: if you have 20 employees on a monthly average, but 10 of them quit every month and you hire 10 to replace them, by the end of the year you will end up with 140 W-2s. You will not need to file, but you may get an IRS Penalty Letter just because you had 50+ W-2s. 😟 Don't get too worried if this is the case... 💡 The ACA mandates that certain employers offer ACA Compliant Medical Coverage to Eligible Employees/Individuals.
