Yellow Is Seeing Red: Bankruptcy Court Invokes Loper Bright in Upholding PBGC Regulations A Delaware bankruptcy court recently issued a highly anticipated decision in the Yellow Corp. bankruptcy that addressed objections to 11 multiemployer pension funds’ withdrawal liability claims totaling $6.5 billion. The plans had received billions in taxpayer-funded Special Financial Assistance (SFA) provided under the American Rescue Plan Act that was not included in plan assets for purposes of the withdrawal liability assessments based upon PBGC regulations. Objectors claim that if the SFA were included in plan assets, the withdrawal liability assessments would have been significantly lower. The decision is the first to invoke the U.S. Supreme Court’s landmark Loper Bright decision to uphold agency regulation of benefit plans and, if it stands, it may provide a roadmap for courts to defer to agency action notwithstanding the elimination of Chevron deference. The Office of the U.S. Trade Representative has released the final modifications to its tariff actions in the Section 301 investigation of China’s Acts, Policies, and Practices Related to Technology Transfer, Intellectual Property, and Innovation after concluding a statutorily mandated four-year review. While the modifications largely followed those proposed in May 2024, the final modifications include: (i) new timing and rates for tariffs on face masks, medical gloves, needles, and syringes; (ii) an exclusion for enteral syringes; (iii) a proposal regarding coverage of additional tungsten, wafers, and polysilicon tariff lines; (iv) an exclusion for ship-to-shore cranes ordered prior to May 14, 2024; (v) an expansion of the scope of the machinery exclusions process to include five additional tariff lines; and (vi) modification of the coverage of proposed exclusions for solar manufacturing equipment. https://lnkd.in/gVPcJqjN #china #tariffs

Data breach involving Social Security numbers could impact millions of Americans. (ABC15 Arizona) “This is clearly one of the largest breaches that we've seen, just based on the pure volume of personal data and records that have been compromised and exposed," said Steve Stransky. Stransky said this kind of breach could present a significant risk to consumers because it involves Social Security numbers, and the damage can be extensive if not caught early.
