Our dear friend, ERISA, is turning 50 this year! ERISA was signed into law on Labor Day, September 2, 1974, by President Gerald Ford. ERISA’s roots began in the early 1960s when the auto manufacturer Studebaker Corporation was unable to fulfill the pension benefits they promised their workers. In the end, Studebaker implemented a plan where 3,600 retirees aged 60 and over received full pension benefits, 4,000 workers aged 40-59 with at least ten years of service got lump-sum payments equivalent to about 15% of their pension value, and 2,900 employees received no pensions. Other companies were also guilty of squandering pension funds and monies set aside for their employees’ retirement. Although it would be almost another decade before ERISA was enacted – the government finally stepped in. Over the past 50 years, ERISA (which also extends to health plans, not just retirement accounts), has been amended to bring us such hits as COBRA, HIPAA, Newborns' and Mothers' Health Protection Act, the Mental Health Parity Act, the Women's Health and Cancer Rights Act, the Affordable Care Act and the Mental Health Parity and Addiction Equity Act.
