    Work-life balance? Paralegal, Bianca Vasallo let us take a peek into hers: After work, you can often find Bianca curled up with a fantasy book and a cup of coffee. "Before, I didn’t have much time to read because I was always commuting, but now, as soon as I finish work, I can just sink into the couch and read," she says. Some afternoons, Bianca also visits her family, especially to spend time with her baby brother. Since she's working remotely with Tukki, Bianca can take short breaks when she needs to recharge. Her mornings start bright and early with a cup of coffee, avocado toast with eggs, or yogurt with granola and strawberries. Bianca loves working from her sunlit office, which gives her an energy boost to kick off her day (isn't it pretty?!). "When I'd just started studying law at university, I dreamed of working as a legal assistant or lawyer to help people. So I’m really happy with my current role as a paralegal because it’s the first step working in the legal field and making a difference. Thanks to Tukki, I’m already helping people, and I get to do it from home with my cat by my side!" 🐱 Reading this made us feel wam inside, thank you Bianca for sharing your story and your home library! 📚

    Earlier in the week, we told you what Executive Capacity means, often misunderstood in the US immigration process. Today, here's Managerial Capacity, which is quite distinct! Do you use this term in your industry? Let us know if this nuance was a surprise to you:

    • ### **Managerial Capacity**

- **Misunderstanding:** Some believe any managerial capacity qualifies for an L-1A visa.
- **Clarification:** The L-1A visa requires that the manager has a significant role in the organization, often with responsibility for major decision-making or oversight of a significant function or department. The role should involve more than just basic managerial tasks.

To qualify as having managerial capacity, you must
be high enough on the org chart that you oversee other people managers or supervisors, not first-line workers. Alternatively, the first-line workers must be university-graduates, i.e. professionals.

    • Executive Capacity

Misunderstanding: Some believe any executive capacity qualifies for an L-1A visa.

Clarification: The L-1A visa requires that the manager or executive has a significant role in the organization, often with responsibility for major decision-making or oversight of a significant function or department. The role should involve more than just basic managerial tasks. To qualify as having executive capacity, you need to be high on the org chart, at least one of these must be true:

You’re reporting to the board of directors

You receive general direction from the board

You’re a senior exec such as a VP reporting to the CEO

You must also be defining and lead policies and strategies for the company or a large part/major function of it, with discretion and latitude in making important decisions.

    • Comparable Evidence (O-1 Visa)

Misunderstanding: Applicants may think that only the specific types of evidence listed in the O-1 visa requirements are acceptable.

Clarification: If the standard forms of evidence (eg. record sales, box office sales or art exhib) are not applicable because they don’t apply to your field, applicants can submit evidence of other achievements that are comparable or analogous and demonstrate the same type of ability.
