Accommodations are not all the same and requests cannot be managed by the same processes lawfully. The new Pregnancy Workers Fairness Act (PWFA) creates some nuances around documentation and duration, to name a few distinctions from the ADA. In addition, while the title of the law references "pregnancy", accommodations extend beyond pregnancy and are required for "limitations related to the pregnancy, childbirth or related medical conditions" of employees pursuant to PWFA. Therefore, to mitigate workforce risks related to managing accommodation requests, employers should ensure their policies are updated and staff is trained to manage processes appropriately and lawfully.
