The Medicare Drug Price Negotiation Program, mandated by the 2022 IRA and implemented by CMS, has withstood multiple legal challenges. Despite pharmaceutical companies’ efforts to have the Program declared unconstitutional, courts have so far upheld the Program due to its voluntary nature.
