🚛 Can the Fifth Amendment Protect a Truck Driver’s Phone Passcode? 📱⚖️ In one of my current cases, the 18-wheeler driver who caused the crash was found with detectable levels of three marijuana metabolites in his system. He has been arrested and charged with manslaughter. But when we asked for the passcode to his iPhone, so my expert can download the device, he invoked the Fifth Amendment—refusing to provide the code because, in his own words, it would incriminate him. 💡 So here’s the legal question: Does the Fifth Amendment protect a truck driver from being forced to disclose his phone passcode? 𝙊𝙣 𝙤𝙣𝙚 𝙝𝙖𝙣𝙙: 📌 The Fifth protects against compelled self-incrimination—meaning the government can’t force you to provide testimony against yourself. 📌 Texas expanded this protection last year under In re Taylor Brock Peters (No. 23-0611; October 4, 2024). 𝙊𝙣 𝙩𝙝𝙚 𝙤𝙩𝙝𝙚𝙧 𝙝𝙖𝙣𝙙: 📌 Courts have ruled that compelling a passcode is not the same as forcing someone to testify—it’s more like handing over a key to a locked safe. 📌 Plus, the contents of the phone already exist—it’s not creating new testimony. 📌 If the trucker’s defense is that he wasn’t distracted, shouldn’t he want his phone records to prove it?
