Position Summary

The Commercial Manager – Contracts (CMC) reports to the Commercial Operations Director and receives strategic and technical direction from assigned Lines of Businesses (LOB) Managers. The CMC is a legal resource to help other Commercial Managers opine and develop contracts for opportunities. The CMC also works closely with the LOB and Sales team to analyze an opportunity’s requirements, determine its winning bid strategy, assign and drive completion of bid responsibilities, evaluate risks, determine market pricing, and run costing and cash flow models to create bids that satisfy the customers’ bid requirements while achieving PROENERGY’s internal requirements for profit and execution. This position is supported by the Sales team, Business Leaders and LOBs to ensure proper scope, costing, pricing, and strategic application throughout the commercial process.

Position Responsibilities

  • Support other Commercial Manager when negotiating contract terms to help develop language required for specific contracts.
  • Work with the Legal team to ensure that terms are consistent with corporate requirements of PROENERGY
  • Support the development and implementation of Commercial strategies in order to provide winning proposals that will generate profit for the Company.
  • Develop, maintain and track proposal information in the Commercial Sales database application (CRM).
  • Support the development of professional proposals and compile supporting documentation to ensure they comply with customer requirements, meet customer deadlines, and subscribe to PROENERGY’s Commercial program requirements.
  • Conduct contract reviews to ensure technical risks are identified and managed.
  • Champion customer solutions that will mitigate their commercial concerns for specific bids.
  • Assemble scope tables and descriptions to facilitate the generation of cost models.
  • Define preliminary project schedules and inputs required for LOB creation of detailed project schedules.
  • Review and customize cash flow analyses on projects to optimize payment milestone proposals.
  • Support Project Turnovers for bid awards and ensure seamless transition to execution.
  • Print/copy/bind/mail hard copy proposals as necessary to meet customer requirements.
  • Compile reference lists, experience lists, and supplemental documents.
  • Communicate bid documents internally and externally.
  • Manage outside vendors when necessary to complete a bid with the generation of preliminary vendor technical specifications
  • Ensure compliance with PROENERGY's Commercial policy and procedures as well as with best industry practices.

Minimum Qualifications

  • Juris Doctorate or Master of Legal Studies
  • 5+ years of commercial contract and proposal development experience.
  • 2+ years of LM6000 or LM2500 technical experience.
  • Must read, write and speak fluent English.
  • US work authorization is a precondition of employment. The company will not consider candidates who require sponsorship for a work-authorized visa.
  • Successful candidate will need to satisfactorily complete pre-employment drug screen and background check

Desired Qualifications

  • Familiarity with and prior experience in the energy industry. Specific experience in gas fired power plant construction is a plus.
  • Ability to work with management, operations and project staff at multiple locations to support the development of detailed technical write-ups.
  • Previous experience responding to Municipality RFP’s is preferred.
  • Excellent communication skills and the ability to collect data from verbal input as well as from hard copy documents; then distill this input into concise technical proposals that can be understood by non-technical reviewers.
  • Editing and proofreading skills are imperative along with the ability to work to a deadline.
  • Ability to facilitate meetings and use input from sales accounts managers, business leaders and the PROENERGY Execution teams to determine the best proposal solutions for customers.

  • Proficient in the use of Adobe Acrobat Pro.
  • Excellent document formatting proficiency in MS Word and proficiency with MS Office.
  • Ability to communicate professionally in verbal and written requirements.
  • Knowledge of principles of business letter writing and report preparation.
  • Knowledge of correct English usage, spelling, grammar and punctuation.
  • Ability to respectfully respond to requests and inquiries from the general public in person and over the telephone.
  • Ability to analyze and resolve problems in a logical and effective manner.
  • Ability to perform business research, compile and analyze data and write clear, concise and accurate reports on complex subjects.
