Here's a question we've been asked a few times recently..."If my employee does not follow the procedure for clocking on and off, can I refuse to pay them?" Under the Fair Work Act 2009, employees must be paid for the hours they work. Withholding payment could breach the Act and lead to legal issues. 🔍 Instead, address the issue by: Reminding and training employees on the importance of following procedures. Implementing a process for reporting missed clock-ins or outs. Taking disciplinary action if necessary, but never withholding pay. Always ensure compliance and protect your business by paying for all hours worked! If you've got a burning HR question, ask away! We're here to help. info@360hrconnect.au #businesstips #employertips #payroll #compliance #fairwork #hrtips #hrsupport

In running a business, there are many federal regulations you must adhere to including, for example, fair labor and equal pay laws. However, according to the IRS, the most common mistake is employee misclassification, which most frequently involves designating a worker as a contractor rather than an employee. This can lead to unwanted legal, financial, and ethical consequences that could hamper your business productivity. By managing your HR department with aplomb or by outsourcing the responsibility through a PEO you will not only save time and money but you’ll be better able to focus on growing your core business and steering your company towards an even brighter and more successful future. #PEO #EmployeeBenefits #HumanResources #Payroll

Payroll Pointers Today's thought is on Pay Frequency. Though there isn't a federal law mandating how often employers pay employees many states do have pay frequency laws. For example, Rhode Island, requires most employers to pay employees once a week unless they have been granted an exception. Employers with an exception must pay their employees twice per month at the minimum. New York State has a pay frequency law based on the type of worker you employ. Manual workers in this state must be paid weekly, whereas clerical workers and other workers can be paid twice per month. Moral of today's story, always be sure to check the statutory requirements when looking into changing pay frequencies. #payrollcompliance #payrollstatutory #uspayroll #payrollmanageropentowork
