Beginning March 19, 2024, the Agricultural Marketing Service (AMS) National Organic Program (NOP) will implement a new, expanded Organics rule to enhance the integrity of the organics supply chain. While AMS will begin with a phased enforcement approach, importers and customs brokers must be prepared. The NOP Import Certificate is a transaction certificate that contains detailed information about the quantity and origin of the product being imported into the U.S. An NOP Import Certificate from a USDA-accredited Certifier is required for every imported organic agricultural product. Customs brokers have asked how to handle organic shipments that are returned to the U.S. (U.S. Goods Returned), since the foreign exporter will not have an organic certificate for the product. For example, bags of organic oats are shipped from the U.S. to Canada. The package is damaged in transit and subsequently rejected by the Canadian entity. When it is returned to the U.S., there is no NOP organic certificate. Can the shipment be imported as organic? The USDA Agriculture Marketing Service (AMS) has provided a special code that can be used in this type of scenario. For organic goods returned to the U.S.: 1.) Only sealed/unopened bags are eligible for organic status upon return. 2.) If these requirements are met, the code for filing in ACE for Certified Organic Goods Returned is 333-550-R (this is filed under OR2). The implementation deadline of 19th March for National Organics Program (NOP) certification for imported products is around the corner. USDA defines three categories of certified organic products, all of which will require an NOP certificate for import. The recent Strengthening Organic Enforcement (SOE) regulations going into effect has created some new and ongoing impacts for the tea industry. 1. Reported organic tea import volumes have increased. This is likely due to requirements that organic imports need an import certificate and are being recorded under the appropriate HS codes. 2. Submitting requests for organic import certificates (NOPICs) has resulted in an additional administrative/paperwork process for the exporter, certifier at origin, and the USDA NOP. This had the potential to create hiccups and potential delays as users became familiar with the system and its requirements. https://lnkd.in/e_PHCU8s
