New Deprivation of Liberty (DOLs) data has been published by the MinistryofJusticeUK undefined. A DOLs Order deprives a child of their liberty in an unregulated secure placement. 1367 children were subject to Deprivation of Liberty applications in 2023. Analysis by Nuffield Family Justice Observatory estimates this is double the number in 2021. NFJO research has found these are often inappropriate placements with severe restrictions on their daily lives, and without the care they desperately need, because there is nowhere else for them to go. 20% of DOLs applications were made by London local authorities. The vast majority of the children are teenagers. Once again there are gaps in recording/systems in relation to the ethnicity of children. Despite the draconian nature of these orders, the children's parents have limited or no access to legal advice & information & are often unrepresented in court - unlike parents of children in care proceedings. Why does that matter? Because families need to: - understand the ways in which their child may be deprived of their liberty - know fair process for the child and family is being followed, in & outside of court - be involved & have a voice in planning for their child - understand their & their child's rights and options. Children diagnosed with special educational needs and disabilities (SEND) are some of the most vulnerable children in our society. These families are already on their knees. The impact on family life, relationships, maternal wellbeing, pupil outcomes and children’s mental health is well documented and INHUMANE. It is a violation of a human right every child is legally entitled to - an education that meets *EACH INDIVIDUAL CHILD’S* needs. So many vulnerable lives have been transformed by access to the independent system and this new legislation will enivetibly restrict access to these settings even more than they already are. The truth of the punitive VAT tax must be exposed and justice for all children and families continued to be fought.
