For Individual termination You must: - provide a minimum of 2 weeks written notice. But for an employee who has completed at least 3 years of service, the minimum notice requirement is equivalent to 1 week per completed year of employment, i.e up to a maximum of 8 weeks of notice, or - pay the employee their regular wages instead of notice Also, a combination of notice and wages instead of notice is permitted. Although there are exceptions where the employee has not completed - 3 consecutive months of continuous employment - terminates their employment - is dismissed for just cause - is on a temporary lay-off that does not constitute a termination of employment - has signed an employment contract that provides a specific end date and that the work ends on that specified date. Most employees only raise concerns/complaints/claims AFTER they are no longer with an organization? Why is that? 1. Perhaps they met with an attorney who shed light on the employer's non-compliance which was only done after the employee left the organization. 2. Perhaps they disagree with why they were let go and/or are upset with how the termination itself was handled, and now want to do something about it. 3. They have time and need $$$ because they are unemployed. I've often said, it doesn't take much for an individual to at the very least speak to an attorney and try to pursue a claim. Consulting with plaintiff-side employment attorneys is very easy. Just google "wrongful termination in ___ (insert state)" and there will be dozens of law firms which will offer free consultations right away. Some/many (depending on who you ask) attorneys are even willing to pursue meritless claims as well just because they view it as a "numbers game." As an employer, you have to ask yourself whether you have done enough throughout that employee's employment lifecycle in terms of compliance and positive and fair treatment toward that employee so that the employee does not even think of talking to an attorney or bringing a claim after that employee leaves. So, I ask these questions to employers: Do you want to take the chance at being sued every time you let someone go? Or Do you want to offer an employment experience (which is both compliant and positive) to your employees where this is not a real concern?
