Difference between land titles and title documents part 2 Before we discuss the various types of land titles, let's consider the two types of land survey plans and the differences between them. A survey plan is a very important document meant to protect your land and document your precious assets in your name. It shows the location and size of a land, It is also used by the government to identify you as the legal owner of that land. The two types include; 📌 Provisional survey plan: This is not legally recognised documentation for your land. It is tentative documentation used in place of a registered survey plan to show you the size, boundaries and coordinates of a land. This can only be used as a guide to creating a building plan so you do not encroach on someone else property 📌 Registered survey plan: This is a legal document processed and documented by a registered surveyor. It is lodged in the cadastral record department of the surveyor general of the state. Do I have to Survey my Property? Some years ago, I was handling some land issues. The first problem was that my client could not tell the exact location of his land. On proper enquiries we saw the land and boom problem number 2 came up, someone had taken it, on further enquiry, the current owner is the third buyer of the property. Big problem, right? My client only has the power of Attorney with no survey plan or further documents to protect his property. A lot of people make this mistake regarding Property Survey, you think you don’t need to survey your property. Some give themselves funny excuses to keep procrastinating about surveying their property. Let me explain why it is important to Survey your property ! 📌 Firstly, A key benefit of land surveying for land development is that it can help to avoid boundary problems, if the boundaries of a property are not clearly defined, it can lead to confusion and disputes between neighbors on the extent or area of the property. By conducting a land survey, you can ensure that the boundaries are clearly defined to avoid encroachment. 📌 Secondly, Location. Land surveying helps you to easily identify the coordinate location of your property. Like the story above, with a survey plan we wouldn’t be looking for the property by tracing the spatial coordinates on enhanced software to accurately determine the location. 📌 Lastly, Documentation. After Surveying your property, you will be given a survey plan. This is a document that shows the legal boundaries of the property, the location, the position of the improvements on the property, details of the owner, date and any easements or encumbrances that may affect the property. A survey plan is a key tool in a power of attorney, giving a pictorial description of the property as stated in the Power of Attorney. Now ask yourself, does my Power of Attorney have a survey plan attached?
