BY JULIANA Embracing the essence of humanity, Section 33 of the Nigerian 1999 Constitution declares the inviolable right to life for every individual. It stands as a foundational commitment, stating that no one shall be intentionally deprived of their right to life. This constitutional guarantee underscores the sanctity we place on life, affirming its significance in our legal framework. However, the law permits certain exceptions where the right in question is not deemed to have been deprived. These instances include the execution of a court sentence for a criminal offense, defense against unlawful violence or protection of property, in order to effect a lawful arrest, prevention of the escape of a lawfully detained person, and suppression of a riot, insurrection, or mutiny. #LegalAidCorpsOsogbo #RightToLife #ConstitutionalRight #nysclegalaid

CDE called on the new Chief Justice, Mandisa Maya, to play an active role in reforming the Judicial Service Commission (JSC) so that the country’s best legal talent can be selected as judges. Speaking at the launch of a new report in CDE’s Agenda 2024 series – ACTION FOUR: How to Appoint a Strong Judiciary – CDE executive director Ann Bernstein set out the case for fundamental reform of the JSC. https://lnkd.in/dxny7rxZ

The second part of James Onalaja’s two-part article analysing the criticisms of the International Criminal Court (ICC) Prosecutor’s applications for arrest warrants in the Palestine Situation is published in this October’s issue of ‘Counsel’, the Journal of the Bar of England and Wales. Following September’s publication of the first part of James Onalaja's article, part-two addresses amongst other matters: the allegations of bias in the investigation and prosecution; potential evidential challenges; alleged failure of complementarity; the potential impact of immunities; the potential impact of the arrest warrants on states supplying arms to parties to the conflict; and the potential impact of the arrest warrants on steps to secure an end to the current hostilities. The UN Working Group on Enforced or Involuntary Disappearances has catalogued tens of thousands of cases of disappeared persons in Gaza. Calls are growing for an international investigation into disappearances as crimes against humanity under international law. Legal experts argue that their systematic nature, often linked to the ongoing conflict, require immediate scrutiny by international bodies and the International Criminal Court, to ensure accountability and delivering justice to the families of the disappeared. At last, a to-be-read paper on crucial issues raised by the on-going crisis in Gaza. We all should however pose one preliminary issue to ourselves: is Hamas equivalent to a State against which self-defence would apply(?) Its astonishing how the debate didn’t focus - in 25 years after 11/9 - on the fact that we’re dealing with something going far beyond what has been conceived after WWII. The world is still in need of a new toolkit to manage the global instability caused by non-State actors
