Lillie Heigl, and a few of her incredibly talented colleagues, spent the better part of the last year researching, writing, editing, re-writing, etc. a comprehensive report focused on the subminimum wage across all 50 states. Today, that report was FINALLY published! If you didn't already know, the subminimum wage is a rate of pay less than the minimum wage (oftentimes as little as pennies per hour) that employers are legally allowed to pay employees based on their perceived level of productivity. The authority for this is found in Section 14(c) of the Fair Labor Standards Act and is almost exclusively used to pay unfair wages to employees with disabilities. While some states have taken active steps to reduce or eliminate this practice, many either continue to adhere to this practice or are waiting on Federal legislative efforts to do away with this entirely. A small loophole in the national minimum wage legislation will be closed on 1 April 2024 for domestic live in workers. Dating back to 1999, it allowed live-in workers who were treated as part of the family to be exempt from the national minimum wage. It was principally designed to facilitate au pairs – where accommodation and meals were provided in return for light housework and childcare. However, following an employment tribunal in 2017 and a subsequent investigation by the Low Pay Commission, it was found that some unscrupulous employers were exploiting the loophole, with migrant workers and women at particular risk. Long hours and duties beyond what the government considered reasonable for an au pair to perform were found to be being imposed in some cases. The amended legislation does not outlaw au pairs; but it does mean they will need to be paid the appropriate minimum wage. #nationalminimumwage #hr #hradvice #outsourcedhr

North Carolina law allows for subminimum wage - employers are allowed to pay a person who has a disability below the current minimum wage (in NC that is $7.25 per hour). Employers are not generally allowed to pay less that 50% of minimum wage ($3.625 per hour) but may be able to pay even less if the person has multiple disabilities or has severe disabilities. National Minimum Wage (NMW) specialists are closely watching tomorrow’s King’s speech, where Employment Rights are expected to take center stage. Significant changes for workers’ rights are anticipated, including: A Genuine Living Wage: The new government has committed to transforming the national minimum wage into a “genuine living wage.” This means that the Low Pay Commission will consider the cost of living alongside median wages and economic conditions. Equalizing Age Groups: Currently, the NMW varies based on age, with a maximum of £11.44 for those aged 21 and over. However, Labour aims to equalize rates across all age groups. Under-18s earning £6.40 per hour would receive the same as those aged 21 and above. Creation of a Worker Rights Agency: The groundwork for this was initially proposed in 2017 by Matthew Taylor as part of the “Good Work Plan”. Prior to the pandemic the Conservative Government intended to establish a new single enforcement body for employment rights, including: - National Minimum Wage compliance - Gangmasters Licensing and Employment Agency Standards. - Enforcement powers regarding Statutory Sick Pay and Holiday Pay rules - Control and transparency requirements in supply chains / modern slavery statement reporting. Given Labours drive to significantly increase workers rights it will be interesting to see their vision for a new single enforcement agency, including the proposed remit, enforcement powers and the budget allocated to a new agency. Employers must make sure that every worker gets atleast the minimum wage for their job. If they do different jobs with different minimum wages, they should get paid accordingly for each job. For example, if one job pays Rs. 20 per hour and another Rs. 10 per hour, and a worker spends 2 hours on each, they should get Rs. 60 for 4 hours of work. Currently the law states that there is no entitlement to the National Minimum Wage (NMW) in respect of work done in relation to an employer’s family household. The current exemptions are intended to cover au pairs, nannies and companions. However, these exemptions have been criticised on the basis that they are indirectly discriminatory towards women. It has therefore been proposed that the exemptions for live-in domestic workers for receiving the NMW will be removed, meaning that those who are affected by the changes will need to make plans to ensure they are not violating NMW regulations come the 1st April 2024.
