The Americans with Disabilities Act (ADA) is a landmark piece of legislation that has changed the landscape of accessibility in the United States. Passed in 1990, the ADA aims to eliminate discrimination against individuals with disabilities in all areas of public life. But what does this mean for you? We compiled responses to a few questions the Department of Justice posed in its NPRM on addressing digital accessibility under Title II of the Americans with Disabilities Act (ADA). Title II seeks to protect people with disabilities from discrimination in participation in services, programs, and activities provided by state and local governments in the United States. It is a complex process that we hope improves the proposed Rule to make it more effective in meeting its fundamental purpose. Link in the first comment.

Thirty-four years ago, Congress passed the Americans with Disabilities Act (ADA). For more than 61 million Americans with disabilities, the ADA has been instrumental in breaking down barriers, promoting independence, and fostering a society where everyone has the opportunity to participate. On October 31, 2023, the Justice Department announced that it has issued guidance to explain how the Americans with Disabilities Act (ADA) applies to state and local government’s employment and day services. The Justice Department’s Civil Rights Division has issued this guidance to help state and local governments understand their nondiscrimination obligations and people with disabilities understand their rights under the federal law in this area. The guidance provides an overview of the ADA, the ADA’s integration mandate, and the types of employment and day services that are often offered to people with disabilities. It then answers nine questions about how the ADA applies to those service systems. The guidance may be found on ada.gov.
