The dismissal of this suit is good news for industry generally. Public nuisance laws were never intended to deal with policy questions that need to be decided by Congress or state legislatures, yet those laws are being used (abused) to further certain policy agendas. Public nuisance laws have their place to deal with very narrow circumstances. Kudos to the judge in Baltimore to tossing this suit. In 2025, the Texas legislature needs to take another stab at clarifying its public nuisance statute to avoid frivolous litigation of this type. Texans for Lawsuit Reform https://lnkd.in/g83u5tUQ

The State of California is seeking an exemption from the U.S. Environmental Protection Agency (EPA) to implement its Advanced Clean Cars II (ACC II) regulation that will ban the sale of internal combustion engines by 2035. If the EPA grants this exemption, roughly 140 million Americans living in 17 states that have followed all or part of California’s previous clean-car rules will lose their ability to choose what motor vehicle best suits the needs of their families. ACC II’s rush to mandate EVs will adversely impact thousands of specialty aftermarket businesses that make parts or components for ICE vehicles, which account for $17 billion in sales annually. I was proud to testify alongside SEMA members before the EPA in opposition to ACC II. SEMA has also rallied our members and automotive enthusiasts who have sent the EPA over 5,000 letters opposing California’s request for a waiver needed to implement ACC II. If you haven’t sent the EPA a letter opposing ACC II, click the link below to sign and personalize a letter outlining why this regulation should not be implemented. https://p2a.co/criacj9
