The Nigerian Shippers' Council (NSC) recently intervened in a dispute involving the damage of two export containers of black eye beans, valued at over $104,000, destined for Jebel Ali Port in Dubai. The beans, shipped by USBAB MULTI CHOICE LTD, were damaged during transit, sparking a disagreement between the exporter, the forwarding agent Inland Container Nigeria Limited (ICNL), and the carrier MAERSK Nigeria Limited. The exporter blamed delays on ICNL and MAERSK, claiming timely shipment could have prevented the damage. ICNL countered, pointing to delays caused by port policies and a hold from the National Drug Law Enforcement Agency (NDLEA), as well as the exporter’s failure to follow advice on proper container dressing. The NSC organized a series of meetings, bringing all relevant parties, including the Federal Produce Inspection Service (FPIS) and pre-shipment agent Anglia International Services Ltd, to review the case. After careful deliberation, the NSC ruled that ICNL was 70% responsible for the damage, while the exporter bore 30% of the liability for not following expert advice. Big Win for Nigeria Customs! Today, the Nigeria Customs Service announced a major bust at Lagos Port intercepting expired and controlled drugs worth NGN 1.8 billion. These weren’t just any drugs. We’re talking about dangerous items like tramadol and codeine, hidden in containers, without any NAFDAC approval. If these drugs had made it out of the port, they could’ve fueled crime and addiction, putting countless lives at risk. The Comptroller-General, Bashir Adewale Adeniyi, led the charge, revealing that 12 containers filled with expired meds, including tramadol, codeine, and more, were seized. Some of these drugs expired just this year, but that didn’t stop smugglers from trying to sneak them in. Imagine the damage these could’ve done if they hit the streets. But thanks to our vigilant Customs officers, led by Comptroller Babatunde Olomu at the Apapa Command, these harmful products will never see the light of day. Earlier today, I had the honour to receive my friend and industry associate, the CG of Nigerian Customs Service, Mr. Bashir Odewale, to discuss timely cargo inspection and clearance to enable us to meet average standards in port competitiveness index. For an efficient port system, we also discussed the commencement of 24-hour cargo clearance, the deployment of scanners at all ports, and the National Single Window, a cross-agency system that allows for the exchange of information, payments, Customs clearance, and port exits. Since we are witnessing a month-on-month spike in export cargo across our ports, we discussed identified bottlenecks and how to reduce them. We will explore all available options to make our ports more competitive and with shorter cargo dwell times.

The UK government has published updated guidance on the Common User Charge (CUC), which applies to imports requiring sanitary and phytosanitary (SPS) checks at government-run Border Control Posts (BCPs). Here’s a breakdown of key points: ⭐Accredited Trusted Trader Scheme (ATTS) pilot participants will need to pay the CUC. ⭐CUC is separate from any inspection fees. ⭐Non-Compliance Penalties: Failure to pay the CUC will incur additional charges. ⭐Importers raising their own CHED on IPAFFS are responsible for the CUC - Include clear billing details on IPAFFS. One of the key initiatives that can help to create a business-friendly environment is reasonable clearance of goods at the ports. Nigeria has not been been able to achieve this despite the implementation of various measures in this regard. The country has had most of the imports destined for her ports diverted to neighbouring countries as a result. One simple thing that we can do is implement a policy of self assessment scheme with respect to goods valuation and the applicable rates. The importer pays on the basis of these self-declared values and rates and get the goods released on that basis. However, the policy must include provision for post audit clearance where the Customs Service can conduct an audit within 6 years of the clearance of such goods. However, to discourage duty evasion and avoidance, there must be stiff penalties and interest for any undervaluation subsequently proved. These changes may need to be incorporated into the enabling law. To manage the complexity that may arise from the implementation of these measures, the Customs Service may need to build capability and capacity. It may also need to adapt its systems, retrain personnel and establish new procedures. These changes are by no means easy but are doable.
