The Nigerian Shippers' Council (NSC) recently intervened in a dispute involving the damage of two export containers of black eye beans, valued at over $104,000, destined for Jebel Ali Port in Dubai. The beans, shipped by USBAB MULTI CHOICE LTD, were damaged during transit, sparking a disagreement between the exporter, the forwarding agent Inland Container Nigeria Limited (ICNL), and the carrier MAERSK Nigeria Limited. The exporter blamed delays on ICNL and MAERSK, claiming timely shipment could have prevented the damage. ICNL countered, pointing to delays caused by port policies and a hold from the National Drug Law Enforcement Agency (NDLEA), as well as the exporter’s failure to follow advice on proper container dressing. The NSC organized a series of meetings, bringing all relevant parties, including the Federal Produce Inspection Service (FPIS) and pre-shipment agent Anglia International Services Ltd, to review the case. After careful deliberation, the NSC ruled that ICNL was 70% responsible for the damage, while the exporter bore 30% of the liability for not following expert advice.
