The rise of litigation funding is reshaping the legal landscape, as in-house counsel and law firms increasingly leverage third-party dispute financing. HB 1179, the pro-consumer bill aimed at regulating third-party litigation financing, addresses concerns regarding transparency and potential overreach by financiers in influencing legal decisions. This consumer-centric bill seeks to bring transparency to the third-party litigation financing industry. The bill prohibits litigation financing companies from receiving a greater portion of the proceeds than the plaintiffs, once attorney fees and costs have been paid. Furthermore, the bill stipulates that litigation financiers would not be allowed to have any input or influence in matters regarding legal strategy. While HB 1179 is supported by organizations like the Florida Justice Reform Institute and the American Tort Reform Foundation, the bill has faced opposition from several pro-trial bar members of the legislature. We are grateful for the leadership of the bill sponsors and committee chairs in proposing this good bill, and we are hopeful that this important consumer-focused legislation will be back on the agenda soon. https://lnkd.in/e22E85nE
