🎲 In this edition of “Know the Law” featuring attorneys Matt Clark and Chris Hagan, we take a break to share a fun fact about gavels in Kern County courtrooms. But while we’re at it, let’s dig in on the practical use of a gavel in today's courtrooms, and how did it come to hold such significance? 🔍 The Gavel Explained: A gavel is traditionally used by judges in courtrooms to call for attention, order, or to punctuate rulings and proclamations. Its sound is a call to respect the judicial process, signaling the beginning or end of a session, or the restoration of order during proceedings. ⚖️ Historical Significance: The use of gavels dates back centuries, with its origins rooted in Ancient Rome. It was adopted in English law and later by American courts, evolving into a symbol of the judge’s authority. Unlike in the United States, where the gavel is a common sight, it's seldom used or seen in British courts today, illustrating cultural differences in legal practices. 🌍 Gavels Around the World: Here, the gavel is a staple of the judicial system, symbolizing the power and authority vested in the judiciary to make legal decisions. In the United Kingdom and Commonwealth, judges rarely use gavels. Instead, the authority of the court is symbolized through other means, such as the wearing of wigs and robes. In International courts the use and symbolism of the gavel can vary, often depending on the legal traditions inherited or adopted by the country. 💡 Symbolism Over Functionality: While the practical use of gavels may have diminished over time, their symbolic value remains potent. After this decision, I’m not sure you could prove assumption of the risk without a written document and a video or more. Feb 16, 2024) A middle school assistant principal fell off a low rope’s balance beam, 12″ high, into wood chips suffering injuries to her leg, ankle, and foot. Here the court went out of its way to find requirements for the defense to prove that were outlandish and impossible.
