In Illinois, business owners can be personally liable for sales taxes under certain conditions. If a business fails to remit collected sales taxes to the Illinois Department of Revenue (IDOR), the state can hold certain “responsible” people, such as owners, officers, or directors, personally liable for these unpaid taxes. Alert to the Out-of-state companies: It started out because either everyone wants to pay tax, or simply wants to make sure their competitors are not better off and pay the tax: "The Town of Gilbert audited RockAuto after a customer brought a RockAuto package to Gilbert’s tax department and “complain[ed] that they were not charged tax.” In 2019, ADOR issued RockAuto a Notice of Proposed Assessment of more than $8 million, which included tax, interest, and penalties." And... the ADOR prevailed. Using distributors who use promotional materials to advertise products in Arizona may result in finding of economic nexus subjecting an out-of-state company to paying sales/ transaction privilege tax in Arizona.
