Understanding Hate Speech Law in India Hate speech laws in India are designed to curb speech that incites violence, discrimination, or hostility against individuals or groups based on race, religion, ethnicity, or other characteristics. These laws aim to maintain public order and protect the dignity of all citizens. Key Provisions: 1. Section 153A of the IPC: This section penalizes promotion of enmity between different groups on grounds of religion, race, place of birth, residence, language, etc., and acts prejudicial to maintenance of harmony. 2. Section 295A of the IPC: This provision deals with deliberate and malicious acts intended to outrage religious feelings of any class by insulting its religion or religious beliefs. 3. Section 505 of the IPC: It addresses statements conducive to public mischief, including those promoting enmity, hatred, or ill-will between classes. Importance: Hate speech laws are crucial for: - Promoting Harmony: Ensuring diverse communities can coexist peacefully. - Protecting Rights: Safeguarding individuals from discrimination and violence. - Maintaining Public Order: Preventing speech that could lead to riots or social unrest. In 2018, the world saw a surge in online hate, with social media becoming a battlefield for free speech vs. hate speech. In a democratic society, free speech is vital for progress and individual autonomy. Yet, the fine line between expressing opinions and inciting hate can blur, leading to social unrest. India’s legal landscape, with provisions like Section 153A and landmark cases like Shreya Singhal v. Union of India, reflects the struggle to balance these rights. The way forward? On certain issues all parties should be 1 in national interest. 1 such issue is of sexually perverted on AV platforms -gravest threat to Bharat’s culture & character. #SaveCultureSaveBharat Foundation appeals to all political parties to include it in their 2024 poll manifestoes & promise that they will take the strongest possible measures against such content makers to stop them. The Foundation has suggested enactment of a Law of Ethics Code that would fix permissible limit for themes, scenes, clothes & language and deem production & distribution of such content as anti-national & rape inducing activity & punish violators with 10 to 20 years of jail on conviction, summary trial in 4 months and no bail for 3 years. As a temporary measure the Foundation has suggested putting such content in one group by amending IT Act & making the group accessible only through Adhaar Card & finger print. The Foundation has also demanded setting up of a National Regulatory Authority to prevent perverted content on all platforms with judicial or quasi judicial powers. The Foundation’s demand for a stringent law against perverted & vulgar content is being echoed by all sections of the society including spiritual leaders cutting across all religions, women and child rights workers & leading citizens & thinkers of the nation. Sexually perverse content has emerged as the biggest cause of increasing & horrendous rapes in India , according to credible studies compiled by the foundation. If nothing is done on this front by political parties & other stake holders in our society then Bharat is on the verge of a cultural disaster.

Bharat is one of the fastest developing country in the world in terms of infrastructure and economy but at the same time crime rate against women's is high ???? Body is the biggest burden for a woman? She does not feel safe inside or outside the house??!!! Few people in our society still consider Women as weak, helpless and economically dependent. Women's still don't get the amount of respect they deserve... Bharatiya women continue to suffer violence in a patriarchal society 😢 😞 😔 💔 When a girl child is born( 50%), the bitter truth in our society is that 'ladki hui hai,' is said in a not-so-happy voice. We are all influenced by gender. Gender norms (or rules) tell us what is appropriate for girls and for boys, women and men to do in our society. Stop telling women how to avoid being raped. “Don’t go out at night” , “Don’t hang out with men you don’t know”  despite the fact that most rapes happen within a woman’s home. Most rapists are husbands, in law's uncles, brothers & close friends. The men that we like to believe are the protectors. People who strongly believe that when a woman gets sexually assaulted or raped, she contributed to it in some way, by wearing (or doing) something. People who think this is completely wrong and can’t understand why anybody would think like that. “Don’t dress like you want it” — Like there’s any situation in which a woman would want to be raped. Despite the fact that men rape women no matter what they wear. Despite the fact that men rape other men, little girls and babies who aren’t wearing “sexy clothing”. (women /kids are still raped no matter how well covered they are.) So let’s stop victim blaming. Let’s focus our energies where they should be; shaming & punishing men for rape. Let us raise a generation of men (and women) that don’t give victims a hard time. #safegirl #healthylifestyle #healthysociety

It is disappointing, anguishing and highly shameful: in our country; women hold equal status as Goddesses yet the same respect is often not extended to women in flesh and blood. It's disheartening to see how unsafe women are from birth until death. Each day is lived with caution, with an ever-present fear of scenarios that we constantly strive to avoid. The problem isn't just about individual actions; it's about the societal norms and perspectives that allow such behavior to persist. Where do we draw the line between freedom and irresponsibility when "freedom of speech" is used to justify any remark? Crime is crime, and no one "calls for it" by merely existing or living their life. It's alarming how often the blame is shifted to the victims rather than addressing the root causes. We all need to think critically about the kind of society we are creating. While not all men are the same, there is a pervasive issue that needs addressing—at both an individual and global level. Real change starts with us, not just waiting for governments and laws to catch up. Let's engage in a meaningful conversation about what we can do, together, to make our world safer for everyone. R.I.P Abhaya, tears and anger can still not justify the fact that we failed you and many others who succumbed silently. We are not different and separate. Demons behind this need very strong action that scares generations to come to even think of such an atrocity on any other human. Overwhelmed to see masses taking to the streets everywhere, this shows the power of common people.
