Daily Sustainability Insight No 6: CAP Revision Escalated On 24 July 2024, ClientEarth and BirdLife Europe filed a complaint with the EU Ombudsman, accusing the EU Commission of bypassing democratic standards to expedite revisions to the Common Agricultural Policy (CAP). The changes, pushed through in March under pressure, reduced environmental requirements for farmers, impacting a €300 billion subsidy mechanism. The Commission consulted only four farming unions, ignoring input from NGOs and citizens. Previous reforms involved over 300,000 stakeholders. The process lacked an impact assessment and excluded critical evidence. BirdLife's attempts to access related documents were met with silence. The CAP revision's weakening of environmental requirements could impact the Baltic States, where agriculture heavily relies on EU subsidies. Local farming operations and sustainability initiatives may face challenges in maintaining high environmental standards without strong EU policies to support them. A coalition of 16 NGOs urged the withdrawal of the proposal, but their plea was unsuccessful. ClientEarth's lawyers condemned the swift revision as "blatantly incompatible with EU law.

Delighted to share that today, with ClientEarth (Ilze Tralmaka) and BirdLife Europe and Central Asia we submitted a joint complaint to the EU Ombudsman, holding the EU Commission accountable over its failure to ensure a democratic revision of the Common Agricultural Policy (CAP). Earlier this year, farmers took to the streets to communicate a crisis in the sector. Instead of looking deeper, the European Commission scrapped environmental protection from farming rules with no regard for well-established democratic processes. 🔦 We are asking the EU Ombudsman to find maladministration in the way the Commission prepared its legislative proposal to revise two CAP regulations. We also ask the Ombudsman to recommend that for any future legislative initiative, on the CAP or else, the Commission better demonstrates how it took into consideration the best available evidence and the public' opinions, and makes publicly available detailed and concrete reasons if deviating from its own internal rules. This is essential to maintain citizens' trust in the EU project. With the far-right on the rise across Europe, more than ever the bloc's executive must guarantee respect for the rule of law and lead by example. 🔍 Specifically, in our complaint we submit that the Commission failed to: - Conduct an impact assessment or otherwise demonstrate how it took into consideration the best available evidence; - Conduct a consistency assessment as legally required by Article 6(4) of the European Climate Law; - Carry out a public consultation; - Guarantee the minimum principles and standards of conducting a targeted consultation; - Convey objectivity and impartiality in communications on the legislative proposal to the public; - Issue a final decision on a request to access Member States' CAP Annual Performance Reports. Our claims are based on the Union's fundamental Treaties, the European Climate Law, the Commission's Better Regulation Guidelines, the Code of Good Administrative Behaviour and Regulation 1049/2001 regarding public access to EU institutions' documents.
