🇪🇺On Thursday Nov 14th, the European Parliament is scheduled to vote on the European Commission's proposal to delay the EUDR implementation to 30 December 2025. At the same time, motions have been tabled for further postponement and amendments to the regulation's content. At Paulig Group, we firmly support the EUDR and its goals. For years, we have worked towards more environmentally and socially just value chains, particularly in our coffee supply chains. Since the regulation came into force in June 2023, we have increased our focus and pace on addressing traceability on no-deforestation. We hope to see the Commission's proposed 12-month delay approved with no further amendments to the regulation's content. Changes to the regulation’s content would dilute its impact and, at this point, create unnecessary confusion and disruption on implementation, as well as legal uncertainty. It is crucial that the regulatory environment remains predictable. This is needed to allow businesses to make well-informed, carefully planned investments and to use our resources and expertise effectively to meet regulatory expectations. 🚨🌲#EUDR - To delay or not to delay!? A brief Friday recap of the past days: 1) The number of public letters, statements, communications demanding the EU Commission to delay the start of the EUDR is ever increasing. 2) Concerns have been raised by industry initiatives, individual companies, members of governments, flagging that practical implementation is not feasible within the short time left. 3) Last week, a spokesperson of the European EPP party quoted European Commission President Ursula von der Leyen as “said she would propose either a postponement or another temporary solution within days”. 4) However, this Wednesday, the EU Commission has informed the German national competent authority (Bundesanstalt für Landwirtschaft und Ernährung) that it will stick to the planned EUDR implementation date on December 30, 2024! Is this Ursula von der Leyen's final official communication? We don’t know yet, but clearly, this is NOT signalling an official delay! Have you already started to put everything in place? I think German sociologist Max Weber talked about how bureaucracy ossifies, self-perpetuating, and self-serving, regardless of the positive intention of a political party, ideology, law, or policy. Not to mention that Italian economist Wilfredo Pereto (the Pereto Principle - the 80/20 rule) implies that 20 percent of the people are doing 80 percent of the real work. Maybe this helps explain why the Supreme Court ruling against the administrative state by declaring the Chevron Deference unconstitutional. Some might also include regulators of pharmacy, drugs, environmental policy, etc. But food ia a great example since there are ingredients in processed food (e.g. cereals) that other parts of the world prohibit, and American bureaucrats approve, and not because the bureaucrats see merit. The European Union (#EU) has recently started to propose dedicated chapters on Sustainable Food Systems (#SFS), which encapsulates the economic, social, and environmental dimensions of food #sustainability in a holistic manner. The article by Rena Eliz Hänel explores the question of whether and in which ways the regulatory approach advanced in SFS chapters in recent EU trade agreements reflects the holistic approach of the SFS framework. It argues that although SFS chapters cover a broad range of policy issues, they do not address the key issues of food security and demand-side interventions. 𝗛𝗼𝘄𝗲𝘃𝗲𝗿, 𝘁𝗵𝗲 𝗣𝗮𝗿𝗹𝗶𝗮𝗺𝗲𝗻𝘁 𝗰𝗮𝗻𝗻𝗼𝘁 𝘂𝗻𝗶𝗹𝗮𝘁𝗲𝗿𝗮𝗹𝗹𝘆 𝗺𝗮𝗸𝗲 𝗰𝗵𝗮𝗻𝗴𝗲𝘀. I therefore sent the text back to trilogue discussions 🤝 with the European Commission and Council, meaning the 𝗳𝗶𝗻𝗮𝗹 𝗰𝗼𝗻𝘁𝗲𝗻𝘁 𝗼𝗳 𝘁𝗵𝗲 𝗘𝗨𝗗𝗥 𝗶𝘀 𝘀𝘁𝗶𝗹𝗹 𝘂𝗻𝗱𝗲𝗰𝗶𝗱𝗲𝗱. 💡 𝗪𝗵𝗮𝘁 𝗱𝗼𝗲𝘀 𝘁𝗵𝗶𝘀 𝗺𝗲𝗮𝗻 𝗳𝗼𝗿 𝘁𝗵𝗲 𝗳𝘂𝘁𝘂𝗿𝗲? 💡 We don't know, it all depends on the outcome of the trilogue discussions. We could now see: - 𝗲𝘃𝗲𝗿𝘆𝘁𝗵𝗶𝗻𝗴 going 𝗯𝗮𝗰𝗸 𝘁𝗼 𝘁𝗵𝗲 𝗱𝗿𝗮𝘄𝗶𝗻𝗴 𝗯𝗼𝗮𝗿𝗱 📝🔄✍️ - with a complete overhaul of the EUDR - only a 𝗼𝗻𝗲-𝘆𝗲𝗮𝗿 𝗱𝗲𝗹𝗮𝘆 ⏳📆🔜 - as most thought would happen - 𝗻𝗼 𝗰𝗵𝗮𝗻𝗴𝗲𝘀 𝗮𝘁 𝗮𝗹𝗹 to the EUDR 🚫🔒📜 - meaning that it will enter into force on 30 December 2024, as originally planned. This creates significant uncertainty ⚠️ for Malaysia’s 🌴 𝗽𝗮𝗹𝗺 𝗼𝗶𝗹, 🌳 𝗿𝘂𝗯𝗯𝗲𝗿 and 🌲 𝘁𝗶𝗺𝗯𝗲𝗿 𝗶𝗻𝗱𝘂𝘀𝘁𝗿𝗶𝗲𝘀, as well as numerous industries relying on palm oil, rubber and timber. For now, the best advice for companies in Malaysia is to stay alert 👀, closely monitor EU regulatory developments 🔔 and be ready to adapt swiftly ⚙️. #palmoil #rubber #timber #EUDR
