Starting 1 July 2024, the Migration Amendment (Strengthening Employer Compliance) Act 2024 introduces new laws to combat migrant worker exploitation. These laws aim to reduce exploitation, increase employer compliance, and improve workplace justice. Employers are prohibited from coercing temporary visa holders or non-citizens into work-related violations and from using a worker’s visa status for exploitation. Fines for employing illegal workers in the UK have tripled, posing serious financial risks for businesses. Two biggest misconceptions about employing migrant workers 👇 1. Illegal working only happens to dodgy businesses that willingly employ these individuals. This isn’t true! I’ve seen businesses in sectors like care and IT get into trouble because their compliance procedures weren't robust enough, or because they hired agency workers through a practice sometimes referred to as "farming." 2. The Home Office will provide some sort of warning, and we will have time to prepare. You will be given no time or prior notice. The Home Office can arrive unannounced, search your premises, request documentation, and begin their investigation at any time. In August alone, 275 premises were investigated by the Home Office in just one week! Of these, 135 notices were issued, and 85 illegal workers were detained. The new rules will affect: (1) BUSINESSES (employers) (businesses that hire individuals without proper work visas, e.g., illegal immigrants, foreign students with no work visa permission); and (2) LANDLORDS (businesses and individuals that offer housing to illegal migrants). OLD RULES Employers: £15,000 penalty per worker (1st breach). Employers: £20,000 penalty per worker (subsequent breaches). NEW RULES Employers: £45,000 penalty per worker (1st breach). Employers: £60,000 penalty per worker (subsequent breaches). OLD RULES Landlords: £80 per lodger (1st breach). Landlords: £1,000 per occupier (1st breach). Landlords: £500 per lodger (subsequent breaches). Landlords: £3,000 per occupier (subsequent breaches). NEW RULES Landlords: £5,000 per lodger (1st breach). Landlords: £10,000 per occupier (1st breach). Landlords: £10,000 per lodger (subsequent breaches). Landlords: £20,000 per occupier (subsequent breaches). Previously, if landlords faced a potential fine of £580 for housing two illegal migrant lodgers they may clearly have been willing to take a risk of getting caught. However, now the financial risk for a rogue landlord would run at £15,000 for the exact same situation. New financial penalties imposed on small businesses (e.g., £105,000 penalty for hiring 2 workers without proper visas) could easily put companies out of business permanently.
