NEW CASE: IMMUNITY OF OFFICIALS AND PERSONNEL OF INTERNATIONAL ORGANIZATIONS: On April 24, 2024, the Supreme Court, through a statement, announced the promulgation of the En Banc case entitled “Westfall v. Locsin, et. al”. In that case, Westfall applied for the position of Technical Advisor in the ADB but was not selected. Later on, Westfall claimed that there were statements in the Panel Notes and Interview Report made by Locsin, et al which were damaging to Westfall’s professional reputation. Locsin, et al were members of the ADB Screening Committee. Westfall then filed a case for damages against Locsin, et al before the RTC of Makati City. Ultimately, the Supreme Court ruled in favor of Locsin, et al noting that “international organizations enjoy almost absolute, if not absolute, immunity. [xxx] On the other hand, "personnel of international organizations are entitled to immunity only for acts performed in their official capacity". Accordingly, "the subject acts were done in their official capacities and thus covered by the functional immunity granted to them as ADB officials". Their upcoming mutual guarantee acquisition project will enhance payment security, create new opportunities for the financial infrastructure of both countries, and promote regional and cross-border trade.
