On 27 June 2024, the Office of the Migration Agents Registration Authority (OMARA) made two sanction decisions. The OMARA barred a former registered migration agent (RMA) from re-registering with the OMARA for a period of two years, following investigation into one complaint in relation to the former RMA’s conduct while registered. The OMARA also cautioned a registered migration agent following an investigation into two complaints about the agent’s conduct. The agent’s caution will be in effect for a period of 12 months and until certain conditions are met. NEW CASE: IMMUNITY OF OFFICIALS AND PERSONNEL OF INTERNATIONAL ORGANIZATIONS: On April 24, 2024, the Supreme Court, through a statement, announced the promulgation of the En Banc case entitled “Westfall v. Locsin, et. al”. In that case, Westfall applied for the position of Technical Advisor in the ADB but was not selected. Later on, Westfall claimed that there were statements in the Panel Notes and Interview Report made by Locsin, et al which were damaging to Westfall’s professional reputation. Locsin, et al were members of the ADB Screening Committee. Westfall then filed a case for damages against Locsin, et al before the RTC of Makati City. Ultimately, the Supreme Court ruled in favor of Locsin, et al noting that “international organizations enjoy almost absolute, if not absolute, immunity. [xxx] On the other hand, "personnel of international organizations are entitled to immunity only for acts performed in their official capacity". Accordingly, "the subject acts were done in their official capacities and thus covered by the functional immunity granted to them as ADB officials". As of writing, the full text of the case has not been published yet. We will post a more comprehensive summary once the full text is published. ***

It is truly exciting to read about the progress in regional cooperation between the Kyrgyz Republic's Elkart and Uzbekistan's Humo payment systems. Their upcoming mutual guarantee acquisition project will enhance payment security, create new opportunities for the financial infrastructure of both countries, and promote regional and cross-border trade. This was a key topic at the recent meeting of the Kyrgyz-Uzbek Business Council, and the agreement to facilitate seamless card payments between our countries without additional commissions is a positive signal for regional development.
