Pleased to share that the legal team at Opportunity Green has submitted a written statement to the International Court of Justice (ICJ) for the advisory proceedings on the Obligations of States in respect of Climate Change. 📃 In our written statement we submit that countries have legal obligations under international climate law as well as the law of the sea to tackle climate impacts from international aviation and shipping in accordance with the Paris Agreement’s 1.5C temperature goal. ❌ Most countries do not take into account these substantive emissions in their national climate plans under the Paris Agreement (so-called NDCs) and rely on the International Maritime Organization and the International Civil Aviation Organization to act. In our submission, we argue that the efforts through these specialised UN agencies are additional to action under countries’ individual NDCs. ⌛️ Our submission comes at a key moment in time, as countries are preparing the next generation of NDCs, due by early 2025. ⚠️BREAKING!⚠️ Opportunity Green asks the International Court of Justice (ICJ) to confirm that States must do more to address the climate impacts from international aviation and shipping (IAS). It is a misconception that States should rely solely on specialised United Nations regulators, the International Maritime Organization and International Civil Aviation Organization, to act on IAS emissions. And yet, this is what most States do in practice. We are talking about major polluters that contribute significantly to the climate crisis – and yet they remain weakly regulated. As our Legal Officer Isabela Keuschnigg says, "For too long, the international aviation and shipping sectors have evaded any serious scrutiny of their decarbonisations efforts." Our submission to the ICJ argues that, not only do these regulators remain off track to meet the Paris temperature goal, but States also have legal obligations beyond the measures of the ICAO and IMO to reduce greenhouse gas emissions from IAS. Forest carbon credits are the subject of much controversy. This piece from ICAO is important in showing that we can now sort the wheat and the chaff. As with anything there are good and bad ways of doing things. High quality carbon credits are a vital source of finance for forest countries. The approach adopted by #Guyana shows what good can look like in this much contested space.
