PNG has recently passed a bifurcated legislative regime regulating arbitration, with the Arbitration (International) Act 2024 governing international arbitration (and the enforcement of foreign awards) and a separate legislation governing domestic arbitration called Arbitration (Domestic) Act 2024. These laws will commence in accordance with a notice in the National Gazette by the Head of State, acting with, and in accordance with, the advice of the Minister. In my next article, I will discuss the practical aspects of the new arbitration regime and what it means for PNG, in terms of domestic arbitrations as well as a seat for conducting international arbitrations.

On 1 June 2024, the 2024 Administered Arbitration Rules of the Hong Kong International Arbitration Centre will come into effect. The 2024 Rules maintain HKIAC’s “light touch” approach to case administration, which respects party autonomy and has been a fundamental feature of HKIAC administered arbitrations. This means that parties who have adopted arbitration under the HKIAC Administered Arbitration Rules in force when the arbitration commences can rest assured that the regime they have adopted continues to apply with no unforeseen drastic changes, while benefitting from enhancements and improvements. The key changes seek to enhance time and cost efficiency of arbitrations, protect their integrity, and promote diversity and greener arbitrations. Many of the changes incorporate HKIAC’s existing practices into the rules. I am pleased to share that I have successfully completed the "International Commercial Arbitration" course provided by the UNCITRAL: United Nations Commission on International Trade Law. This program provided a thorough overview of international commercial arbitration, focusing on the core principles governing arbitration, including party autonomy, confidentiality, and the enforcement of arbitral awards. The course covered key topics such as the basics of international commercial arbitration, the scope and key provisions of the New York Convention (1958), and the principles and structure of the UNCITRAL Model Law (1985, with amendments as adopted in 2006). It also highlighted UNCITRAL’s role in harmonizing legal texts and instruments, while discussing the advantages of international commercial arbitration.
