RESOLVING BUSINESS CONFLICTS UNDER ARBITRATION PROCEDURES AT THE INTERNATIONAL CHAMBER OF COMMERCE The International Court of Arbitration, as an autonomous body within the framework of the International Chamber of Commerce, ICC (Angeon & Callois, 2005), stands as a stalwart institution in resolving disputes arising from international trade contracts (Diemer, 2014). The study, recently published in our journal Corporate Law and Governance Review aims to delve into the intricate legal framework governing arbitral proceedings under the purview of the ICC, addressing key legal issues that emerge within this domain. The research scrutinizes the procedural mechanisms employed by the arbitral tribunal from the initiation of arbitration proceedings to the issuance of awards, elucidating their function and impacts. This research contributes to a deeper understanding of the legal intricacies surrounding arbitration within the ICC, thereby facilitating decision-making, and fostering greater confidence in the dispute-resolution process of international trade. The study, by integrating theoretical frameworks and qualitative analysis of data, found that the ICC achieved more procedural integrity, and cultivated a dependable repository of information for addressing corporate conflicts. The Role of International Contracts in Resolving Disputes Through International Arbitration Commercial relations often face critical disputes that jeopardize their stability. National courts, traditionally tasked with resolving such disputes, frequently fail to address them timely and professionally, creating a void effectively filled by international arbitration. This mechanism has become the most widely used private dispute resolution method in the commercial sector. Parties voluntarily agree to arbitration by incorporating an arbitration clause into their primary contracts or by signing a separate arbitration agreement, endowing the arbitral tribunal with jurisdiction and authority to resolve the dispute. An international arbitration agreement is thus a cornerstone of the arbitration process, foundational to almost every arbitration. If such an agreement or clause is not effectively and professionally formulated, it may lead to future disputes, unjust consequences, extravagant legal costs, and ultimately, injustice. On 1 June 2024, the 2024 Administered Arbitration Rules of the Hong Kong International Arbitration Centre will come into effect. The 2024 Rules maintain HKIAC’s “light touch” approach to case administration, which respects party autonomy and has been a fundamental feature of HKIAC administered arbitrations. This means that parties who have adopted arbitration under the HKIAC Administered Arbitration Rules in force when the arbitration commences can rest assured that the regime they have adopted continues to apply with no unforeseen drastic changes, while benefitting from enhancements and improvements. The key changes seek to enhance time and cost efficiency of arbitrations, protect their integrity, and promote diversity and greener arbitrations. Many of the changes incorporate HKIAC’s existing practices into the rules.
