A critical Subsidy Advice Unit report has been published today, which underlines how important it is that public authorities take the CMA referral process seriously and prepare properly. South Yorkshire Mayoral Combined Authority referred a £11.6m subsidy to the CMA in November 2023, which it was proposed would be awarded to Capital and Centric (505) Limited to develop the former Cannon Brewery site in Sheffield’s Neepsend area. Today’s report says the assessment could be “significantly improved”, criticising “brief” evidence and the failure to engage in “pre-referral discussions before referring the subsidy, as encouraged by the SAU guidance”. The Combined Authority can now use the findings of the report to update and improve its assessment. However, when a similarly critical SAU report was issued to Warrington Borough Council in June 2023 in respect of a proposal to subsidise Warrington Livewire’s leisure services, it led to the proposal being cancelled, with the Council decision stating that “given the report identifies significant areas of potential improvement which an interested party could form their challenge around, there is deemed to be a risk of a successful challenge, should one be brought”. Therefore, the lesson for public authorities is clear - engage with the referral process early on and building up a credible case against the requirements set out in the Subsidy Control Act 2022, secondary legislation and related guidance. By doing so, the CMA report can be used to fine tune your Subsidy Control assessment, thereby reducing the risk of a successful challenge by a competitor of the recipient of the subsidy. Liberal Democrats continue to pledge water structural reform in manifesto The Liberal Democrats have published their manifesto ahead of the General Election. Many of the key pledges remain from the policy document they published in March. They continue to promise that they will effect structural change in the water sector, changing ownership and replacing Ofwat. Facts of the case: IA is filed by Learned RP- Sec60(5) and reg 34 CIRP 2016 Seeking payment/contribution of IRP costs and expenses incurred during the process. First COC-Fees and expenses incurred by applicant as IRP were ratified. Professional fee of IRP for entire CIRP also voted for. Fifth COC Unpaid CIRP costs and estimated expenditure for future was brought up for discussion.But it was not approved.One member has paid his share but other 2 COC members did. not. 6th COC Despite ratification of CIRP costs some members did not pay their share of contribution. 7th and 8th COC Topic of unpaid CIRP costs was again brought out. Order of AA: Making general statement that CIRP costs are exorbitant is inadequate, needs to be substantiate the assertion by documents. CIRP costs were approved in COC meetings. Withdrawal of claims by FC- IBC does not permit withdrawal of claims COC meeting to be convened and approval of costs based on documentation Withdrawal from CIRP is permitted subject to decision by AA after paying the claims of CIRP costs.

Did you know that the NASC has dropped the joining criteria of having a minimum 75% PAYE? This means if you run a business and use subbies as your labour force you can still apply. You must have been trading for at least two years have a current SSIP accreditation also have CISRS-carded scaffolders. Which in general most companies can easily achieve. The process can be done within a timescale of four weeks instead of the old three to six months period. The new CEO is taking the direction of the NASC where it should have gone years ago. They are still the only scaffold association/confederation that produces industry guidance so what are you waiting for? We can assist anyone wishing to progress.
