No MileSTONE Unturned! Amidst some tricky environmental laws we have successfully assisted one of our dear clients in an appeal before the Water Tribunal – without making waves! The Water Tribunal directed the Department of Water and Sanitation (DWS) to issue our client with an integrated water use licence, authorising the development and operation of a mine residue deposit with an alternative barrier system to that which is usually prescribed by the DWS known as a Class C Barrier. On December 14, 2023, the U.S. Environmental Protection Agency EPA released its Second Annual Progress Report to its 2021 PFAS Strategic Roadmap, summarizing updates on the agency’s actions and goals to address per- and polyfluoroalkyl substances, also known as PFAS. Although beyond the scope of this Alert, it is notable that many of EPA’s actions and proposed actions have faced opposition by various parties.
