In the debate over immigration and crime, focusing solely on the raw number of crimes can obscure important insights. Crime rates and population size matter more than just counting incidents.

🗣️ Immigration does not bring on a crime wave. Yet, politicians continue to push this false and harmful narrative. According to extensive research from Stanford University, immigrants are 60% less likely to be incarcerated than people born in the United States. Additionally, recent investigations by The New York Times, and the Marshall Project found that between 2007 and 2016, there was no link between undocumented immigrants and a rise in violent or property crime. False information distracts from the work needed to build an immigration system that is both functional and humane. Instead of pushing xenophobic rhetoric, decision makers must bring the country’s approach to immigration in line with the needs of the moment. https://lnkd.in/emV4eQHA

Undocumented individuals must have the ability to report abuse safely, without fear of punishment such as detention or deportation when they come forward. ✅ A noncitizen or immigrant in the US arrested and detained by the US government (Department of Homeland Security (DHS)) can be released from custody upon the payment of bond. ✅ A bond is a guarantee to the government that, if you are let out of detention, you will go to all of your hearings and will obey the judge's order at the end of the case. To be let out of the detention center “on bond”, you or a friend or relative must pay the bond money to DHS. If you go to all your immigration hearings or interviews, whoever paid your bond will get the money back when your case is over. If you lose your case, you must report to DHS for departure when required or you will not get the bond money back. ✅ A request for a bond hearing may be made in writing, may be made orally in court or, at the discretion of the immigration judge, by telephone. AILA has published a report on how the prosecution of immigrants for entry without inspection has increased. Presence in the US without proper authorization is a civil violation, rather than a criminal offense. However, those who enter or reenter the US without permission can face criminal charges. There are heavy costs on both the migrants and the government. The prosecution of individuals fleeing persecution harms family members with whom the individual traveled, since spouses are often separated, as are parents from their minor children. For the government, such prosecutions are a costly use of resources and have no demonstrated deterrent effect on future migration. https://lnkd.in/gNuSBUYF #USImmigration #immigration #migrants #removal #asylum

Some people can't even report theft, rape or murder. A new EU directive could change this, but discussions aren't going in the right direction. The EU Victims’ Rights Directive, which sets out minimum rights for victims of abuse across the EU, is currently being revised and the civil liberties and women’s rights committees of the European Parliament should vote on their position in April. The revision proposed by the European Commission includes a prohibition for law enforcement to share personal data related to the victim’s migration status with immigration enforcement only while the first needs assessment is completed. This partial shield is not enough. Undocumented people must be able to trust that they will not face immigration consequences, including detention and deportation, throughout the reporting process. Today we join over 40 human rights organisations in calling on EU lawmakers to take a clear stance for safety and protection for all victims, and ensure that no data transfer occurs between police and immigration enforcement as a result of undocumented victims reporting abuse.
