Following along with the ongoing NCAA Convention panels and sessions, there are some invaluable lessons to gained. From the NIL session hosted Thursday afternoon with a handful of current and former collegiate student-athletes that have participated in NIL opportunities, I have a few takeaways: • Student-athletes can and should review the available applications to find opportunities in NIL marketplaces, and not shy away from spreading their profile and brand across a multitude of these applications. • Understand the contracts and deals you are pursuing, particularly in differentiating exclusive and non-exclusive deals and partnerships. • There is a need to dispel the myth of the get rich quick idea of NIL deals when the deals can be the difference between continuing education while competing as a student-athlete. An NIL deal for athletes can be the matter of being able to pay for books or “ordering queso at Chipotle.” • For student-athletes, NIL deals can expand beyond the immediacy of a financial benefit while still enrolled in school. There are additional opportunities to establish connections following the completion of a degree. On July 11, 2024, a Third Circuit panel held in the seminal decision Johnson v. NCAA that NCAA athletes can be employees of universities for purposes of the Fair Labor Standards Act (FLSA) solely by virtue of their participation in interscholastic athletics. As part of its decision, the Third Circuit rejected the “frayed tradition” of amateurism as a defense to shield FLSA claims from college athletes. Are we paying attention to what is happening to the smaller, private college sports programs? Great Forbes article by #PennGSE Professor Dr. Karen Weaver at the University of Pennsylvania Graduate School of Education as an introduction to the changing landscape of collegiate athletics. So much of the focus is on NCAA Division I programs, but that narrow view leaves out so much of the post-secondary athletic population. Playing sports in college is an honor that so few high school athletes experience. So, when the opportunity arises, how are students able to maximize their chance to continue to play? NCAA Divisions I, II, and III are certainly options, but we also have to keep NAIA and NJCAA schools in the conversation. If the research is showing that NCAA DIII schools are in jeopardy, what then is the fate of programs in the other athletic organizations? In Baltimore City schools, student-athletes comprise the largest number of graduates in the district. I work with these students every day. I only hope that they continue to have a college - NCAA DII or DIII, as well as NAIA and JUCO - to attend and live out their aspirations as students and athletes. #LinkedInsports
