SEC Likely to Classify ETH Under Investor Protection Law, Says Consensys Legal Advisor According to Odaily, Bill Hughes, the Senior Legal Advisor and Global Director of Regulatory Affairs at Consensys, has stated in an interview that the U.S. Securities and Exchange Commission (SEC) is likely to classify Ethereum (ETH) under the Investor Protection Law. In October 2023, the SEC permitted futures exchange-traded funds (ETFs) based on Ethereum to be traded on securities exchange platforms. This indicated that the asset underlying the futures contract was not a security. However, certain developments since then seem to have led the SEC to reconsider its stance. Hughes' comments suggest a potential shift in the regulatory landscape for Ethereum, one of the leading cryptocurrencies. #SEC Charges Investment Advisory Firm with #Recordkeeping and Other Failures The Securities and Exchange Commission (SEC) has charged an investment advisory firm for multiple #compliance failures, including inadequate recordkeeping and a failure to enforce its code of ethics. The firm admitted to these violations, acknowledging their breach of federal securities laws, and agreed to pay a $6.5 million penalty. Additionally, they have committed to implementing improvements to their compliance policies and procedures. Among the failures cited, the firm Management neglected to maintain and preserve certain electronic communications as required by law and internal policies. Notably, senior employees were found to have engaged in off-channel communications using personal devices set to automatically delete messages after 30 days, further violating regulatory standards. For example, Kirkland & Ellis, which is the world’s largest law firm by revenue, brought in more than $120m for its work as lead counsel for three crypto firms that filed for bankruptcy — BlockFi, Celsius Network and Voyager Digital — Bloomberg reported. This was significantly higher than the $42m it made as a counsel on the bankruptcy cases of WeWork and RITE AID last year. Crypto’s volatile nature and growing popularity among institutional clients has led to law firms establishing their own specialist crypto teams. Some of the world’s largest law firms, including Latham & Watkins, Baker McKenzie and Linklaters, now have dedicated blockchain and crypto units. DLA Piper also established a blockchain firm called #TOKO in 2019. While the struggles of and institutional interest in the sector have proven lucrative for big law firms, in-house legal experts at banks, asset managers and hedge funds have also looked to cash in on the growing popularity of digital assets. Ehsan Haque, head of UK legal and compliance at Nomrua’s crypto arm Laser Digital, said that the fast‑moving nature of crypto makes it an interesting place to work.
