CANNRA submitted a comment today on the proposed federal rule rescheduling marijuana (Docket No. DEA-1362) today. The comment does not take a position on rescheduling, but rather focuses on implementation of the proposed federal rescheduling in U.S. states and territories. The comment calls for additional federal guidance in six areas to support state and territorial regulators in being able to implement the policy: 1. Guidance is needed on how federal priorities, including enforcement priorities, will change under the proposed rescheduling. 2. Guidance is needed on how federal agencies will engage with states and territories under the proposed rescheduling. 3. Guidance is needed on how state governments can interact with each other under the proposed rescheduling. 4. Guidance is needed on how research processes and protocols will change under the proposed rescheduling. 5. Guidance is needed on how to regulate cannabinoids that appear in two different places on the schedule due to the federal legalization of hemp. 6. Guidance is needed on how the proposed rescheduling will impact banking and finance directives and policies. Guidance in these six areas is vital to the successful implementation of the final rule on rescheduling. Without it, state and territorial government agencies will be left to guess and hypothesize about federal-state dynamics and the potential impacts on state-regulated programs, the state populations affected by those programs, and the states in which those programs operate. It is imperative that the DEA undertakes a thorough review and subsequent reclassification of marijuana within its scheduling system. The current classification not only contradicts the growing body of scientific evidence regarding its medicinal benefits but also overlooks the shifting public perception and legal status at the state level. Moreover, rescheduling marijuana promises significant advantages for business, opening up opportunities for legal commerce, innovation, and job creation within a regulated market. This move would also enhance personal safety by mitigating the risks associated with unregulated markets, such as product contamination and exposure to criminal activities. Pennsylvania House lawmakers have introduced a bill to legalize marijuana just ahead of the Health Subcommittee on Health Care meeting scheduled this week. The bill is identical to a bipartisan Senate cannabis legalization measure filed last year. Rep. Amen Brown, the lead sponsor, says the bill is "grounded in safety and social equity." Here's what the bill addresses: ➡️ Sets the minimum marijuana consumption age at 21 years old and provides law enforcement the means to adjudicate driving under the influence and eradicate any illicit market. ➡️ The proposal would allow limited home cultivation for medical cannabis patients while prioritizing social equity licensing and expunging prior marijuana convictions. Just published: Marketed as federally legal and akin to marijuana, D9-THC alternatives are gaining traction among adolescents. A recent study by Alyssa Harlow, Richard Miech, and Adam Leventhal underscores the urgent need for comprehensive surveillance, policy, and public health measures to address the rising prevalence of Δ8-THC use. The prevalence of Δ8-tetrahydrocannabinol (Δ8-THC) use among 12th-grade students in the US is notably high, with 11.4% reporting its use in the past year, compared to 30.4% for ‘marijuana’. This trend is especially pronounced in the South and Midwest and in states lacking legal adult-use marijuana or specific Δ8-THC regulations. The findings highlight the impact of the current fragmented and incomplete federal cannabis regulation, which may be inadvertently promoting the use of synthetic alternatives like Δ8-THC. #cannabis #regulation #riskmanagement

The U.S. Department of Justice sent for filing to the Federal Register on May 16, 2024 the proposed regulations. We do not yet know what date(s) hearings will be held and public comments posted. Filing with the Federal Register starts to formal rulemaking to change moving marijuana from a Schedule I to a Schedule III drug under the Controlled Substances Act (CSA).
