📢 UNESCO Launches Open Consultation on New Guidelines for AI Use in Judicial Systems "UNESCO’s recent survey of judicial operators worldwide has highlighted a significant lack of institutional guidance and training on the use of AI systems. In response, UNESCO, in collaboration with international experts, has developed draft Guidelines for AI use in Courts and Tribunals. “The guidelines, shaped by the UNESCO Recommendation on the Ethics of AI, aim to ensure AI technologies are integrated into judicial systems in a way that upholds justice, human rights and the rule of law." UNESCO survey found that ➡ +35000 judicial operators participated in the UNESCO Global Judges Initiative ➡ 160 countries impacted ➡ 44% of respondent judges use ChatGPT and other LLMs for work purposes ➡ Only 9% of them receive training or have institutional guidelines in place ➡ 92% of them call for mandatory regulations & training The draft Guidelines for AI use in Courts and Tribunals is based on UNESCO’s Global Toolkit on AI & the Rule of Law. The UNESCO Toolkit is for national judicial training institutions, universities, and other legal education organisations. CAIDP urges commentators on the UNESCO Guidelines on AI Use in Judicial Systems to emphasize the need for 🔥 A clear recognition of the difference between deterministic AI systems (rule-based) and probabilistic AI systems (LLMs) 🔥 An ongoing commitment to fairness, accountability, and transparency in the use of all AI systems for judicial administration 🔥 Meaningful contestability (not simply "explainability") in all decisions impacting the rights of individuals 🔥 Prohibitions on the use of AI systems that produce adverse impacts based on machine-determined criteria or fail to comply with human rights norms 🔥 Data protection, privacy, and confidentiality in the use of AI systems that collect personal data 🔥 Not "human in the loop" for AI in the judiciary but "AI in the loop, in some circumstances, after proper assessment, and with ongoing review" 🔥 The centrality of human decisionmaking in the administration of justice CAIDP also calls attention to the following judicial decisions on the use of AI 🏛 Ligue des droits humains, C-817/19 (CJEU 2022) 🏛 AI and the Judiciary (Cololmbia Constitutional Court 2024) This is an important Public Voice Opportunity - express your views!
