Recent Rulings by the Court of Justice of the European Union in Cases C-474/22 (Laudamotion - Decision not to take a delayed flight) and C-54/23 (Laudamotion and Ryanair):
The Court has clarified that passengers who opted not to board a flight experiencing a considerable delay or those who purchased tickets for alternative flights and reached their destination with a delay of less than three hours, are not eligible for fixed compensation.
A well-reasoned decision that strikes a balance between protecting passenger rights and acknowledging the practicalities of air travel operations.

📢 Can passengers receive compensation under Regulation 261/2004 in scenarios governed by the 1999 Montreal Convention?
🔍In our April 2024 newsletter, our colleagues José Antonio Romero Lara and Silvia Frade Sosa explore the scope of application and compensation framework outlined in the Montreal Convention, highlighting practical discrepancies that arise when the provisions of Regulation (EC) 261/20043 are improperly applied in Spain to aviation incidents governed by the Montreal Convention.

The current proposed compromises on Single European Sky (SES) fall far short of what passengers and the environment deserve and what airlines expect.
Ahead of a "trilogue" negotiation amongst the three main EU institutions tomorrow, A4E has analysed what is needed to deliver an effective SES and how far we will fall short if the current compromises are passed.

Latest News Flying more circuitous routes increases flight times and fuel expenses for airlines, and complicates schedules that depend on aircraft being in the right place at the right time
The European Union and individual governments are making – or avoiding – big decisions that critically impact European air transport. But increasingly, aviation stakeholders are questioning whether those decisions are good policy, or just pragmatic politics, writes Tony Harrington for the latest edition of Airside.

Just copy of the abstract of my recent article on the 2023 reform of the Argentine Aviation Code (L.17285/67). Highly controversial from the constitutional and legal points of view, more details to come #aviation#code#aviationlaw#lawofthesea#overflight#reform
Aviation industry is more to be consolidated and merged in the next decade. I think we will see more acquisition and merge as well as strengthening partnerships through JVs or forming new groups to grant new market access and sustain the growth.
Further, lack of af airport infrastructure to accommodate the growth will push regulators to moves towards commercialization and privatization to attract private sector, however; this depends both on government objectives and the requirements to protect national interests and build their national champions globally as new players in the international market. Otherwise, the existing international operators will advantage from many opportunities that will lead to monopoly in the airport industry internationally.
Finally, it is all about striking the right balance between the supply and demand and how governments/ regulators build a solid economic regulations to allow liberalization, encourage international partnerships through alliances, sister agreements or JVs and attract investments in order to bring competition, improve service levels and protect national champions to maximize GDP and achieve sustainability and success.

After two decades, the #EU has reached a provisional agreement on reforming its air traffic network through the Single European Sky initiative, aiming to cut carbon emissions by 10%. This effort seeks to enhance Europe's airspace capacity, reduce navigation costs, and mitigate aviation's environmental impact.
Despite the optimism from air navigation service providers, the #airline industry fears the reforms may fall short. The agreement introduces binding targets for more efficient and eco-friendly flights, with an advisory board overseeing implementation.
However, airline representatives express concerns over the reform's scope and enforcement, signaling ongoing debates on achieving a seamless European sky that benefits all stakeholders.
