City of Seguin Purchasing Manager Ashley Bruns has been chosen as the Employee of the Month for April 2024. In the short time since she's been Purchasing Manager, Ashley has taken her department (and the City of Seguin) to the next level by implementing new processes, procedures and services. Most notably, Ashley transitioned the city into a new era of competitive bidding when she implemented Bidnet, an online bidding platform. Ashley's high level of customer service shines when she provides guidance that can be easily understood by vendors. She is not only an exceptional leader/manager, but also a team player. In addition to supporting her staff with training, Ashley goes above and beyond to help other city departments when they have questions about bids, specs and purchasing procedures. Sunny outlook for WHSmith ☀️👀 High street and airport bookseller and stationer WH Smith, which has its headquarters in Swindon, says it is on track to deliver full year trading in line with expectations. In a statement today it said it is well positioned for the peak summer trading period. Its UK travel division saw total revenues up nine per cent in the 13 weeks to June 1 this year. The transformation of the business to a one-stop-shop for travel essentials is delivering strong results, increasing average transaction values and returns. As part of its category development initiatives to expand the breadth and quality of its food-to-go ranges, the retailer recently launched a new food-to-go brand, Smiths Family Kitchen, in more than 300 Travel stores. Revenues are also up in its North American division, up five per cent – on a constant currency basis. Like for Like sales were flat, so the retailer is introducing a range of initiatives including focussing on higher performing categories, increasing snacking and confectionery and the number of chillers in store. The recent case of Lidl Great Britain Ltd -v- Closed Circuit Cooling Ltd is an intriguing read. The three takeaways are: (1) a hybrid payment and payment notice is likely to be invalid (2) an adjudicator is entitled to consider certain matters even though they might not have been articulated in submissions, and even though the parties have not been asked to comment on the matter, and (3) the principle of estoppel by convention means that a payer cannot argue that a payment application fails to meet the precise terms of the contract if applications in similar terms have been treated as valid throughout the contract.

A big part of this is the new Grocery Code, and the requirement to have formal written contracts between all suppliers and retailers. Regardless of size, if you're trading with any of the major retailers you should have received a copy of the proposed agreement and ideally taken the time to really dig in and understand the commercial implications for your business. A snip from the ComCom as reminder of upcoming deadlines this quarter: "RGRs (Regulated Grocery Retailers) have until 28 March 2024 to offer their suppliers any necessary variations to ensure existing agreements are consistent with the Code. SAVVY INSIGHTS: Congratulations to JD Wetherspoon! JD Wetherspoon has delivered impressive results with a profit before tax of £42.6 million, fueled by a remarkable 12.7% rise in like-for-like sales for the 12 months ending July 2023. During this period, the company expanded with the opening of three new pubs while strategically managing its estate. Total sales for the year reached £1.9 billion, marking an 11% increase, with standout growth in food sales at 17.7% and hotel rooms at 11.8%. Underlying profit soared from £25.7 million to an impressive £107.1 million, while profit before tax rebounded to £42 million from a loss of £30 million in 2022. Last Salinas season we were introduced to a new shipper through one of our larger shipper customers. This new customer was having issues with their produce loads going from CA to NJ. Their pricing and service level were not up to par with what we were providing our customers, and we knew we could help them see immediate improvements. They had been working with their incumbent for the past ten years. But after an honest analysis, we were able to save them money and improve their service levels on both LTL and TL shipments. We also worked collaboratively with their buying teams to avoid any outs at the warehouse level. Through strong communication we eliminated issues they had been facing. Within six months we were covering all of their inbound freight (not just produce) and this January we started moving a portion of their outbound freight as well. I am a huge advocate for respecting your incumbents and relationships, but a partnership needs to be serving you each year. That renewal of business should be earned not given. You want a good price, but you don’t want lousy workmanship. What’s a buyer to do? New research from Kellogg's Nicola Persico, Pino Lopomo of Duke University, and Alessandro Villa of the Federal Reserve Bank of Chicago demonstrates that the optimal way to find a supplier when you have quality concerns is to set a floor price under which bids will not be considered. That prevents higher-quality suppliers from being outbid in the bidding process and in turn decreases the likelihood that the contract will go to a supplier that’s shady or underqualified.
