On June 26, 2024, at the Future Fabrics Expo our founder Muchaneta ten Napel had the honour of joining a dynamic panel on "How Legal and Policy Frameworks Can Set the Right Parameters for Social and Environmental Justice." Moderated by Bella Webb of Vogue Business, the discussion explored the complex relationship between fashion, legislation, and sustainability. Here are some key insights she shared during the conversation: 🔍 "One of the problems that we’re facing is inconsistency in regulations across member states. If we’re all going in different directions, we don’t go anywhere." ⏳ "The fashion industry is moving at a very slow pace, which is a big problem because we need to move faster in order to make change and to make a difference." 🤝 "It’s no longer a 'me' problem; it’s a 'we' problem. How can we, as an industry, comply with these upcoming legislations in a way that leaves no one behind?" 📢 "The lawmakers know nothing about the fashion industry, so fashion as a whole needs to be part of this conversation. We don’t have a voice in Brussels, and that’s a problem." 📚 "The industry has shown that it can’t self-regulate, so who’s going to suffer? It’s going to be anyone who doesn’t educate themselves about what’s coming and what’s happening." WARNING TO CHURCHES AND CLUBS: UPHOLD NOISE AND ENVIRONMENTAL STANDARDS OR FACE CLOSURE The recent ruling in ELC Petition No. E031 of 2022, Amani Residents Welfare Associations v Mark Senteu T/A Cocorico Wines and 4 others is a stark reminder of the importance is a landmark case that has set a precedent, showcasing the judiciary's commitment to upholding citizens' constitutional rights to enjoyment of one's property and clean living environment. Case #Background Residents of Amani Estate filed a petition against several establishments, including nightclubs and a church, for violating their right to a peaceful and clean environment. The petitioners cited excessive noise pollution, raw sewage discharge, and the inappropriate location of these establishments in a residential area as their primary concerns. #Determination & Court's #Finding. The court confirmed that the petitioners' right to peacefully enjoy their property and live in a clean environment was violated. #Threshold for Noise #Pollution The court highlighted that noise pollution is not solely determined by scientific measurements but also by considering factors such as: *Time of day *Proximity to residential areas *Frequency and intensity of noise *Use of electronic amplification -Balancing #Freedom of #Religion and #Property #Rights While acknowledging the right to freedom of religion, the court emphasized that it should not infringe upon others' rights to peaceful enjoyment of their property. The church's activities, which caused significant noise pollution, were found to be in violation of this balance. #Negligence by #Authorities: Both NEMA and the licensing authority were found to have neglected their duties, contributing to the violation of the residents' rights. The court fined the church, night club and NEMA Kshs. #5Million. The court ruled in favor of the Residents of Amani Estate, ordering the closure of the offending nightclubs and church. #Conclusion This case serves as a critical reminder to all establishments, including religious institutions and social clubs, to respect environmental laws and the rights of residents. Failure to do so can result in severe legal repercussions, including closures and financial liability. There is therefore a need for balance between operational freedoms and environmental responsibilities.

Rosamund Adoo Kissi-Debrah is suing the UK government for causing the illness and premature death of her daughter Ella. In the last few days, the petition to get 'Ella's Law' (Clean Air Human Rights Bill) through parliament was closed. The response from the government was in part, as follows: 'As such, the government fully recognises the positive intention behind the Clean Air (Human Rights) Bill, however, we already have a comprehensive existing legal framework that allows us the capability, accountability and ambition we need to make effective interventions to drive down air pollution.' Adoo-Kissi-Debrah's lawsuit targets three government departments: 🔵 Department for Environment, Food and Rural Affairs: Accused of failing to meet legal air quality limits and implement effective pollution control measures. 🔵 Department for Transport: Allegedly contributing to excessive air pollution through inadequate regulation of traffic emissions. 🔵 Department of Health and Social Care: Claimed to have neglected the health risks associated with air pollution and failed to provide adequate guidance to protect the public. While compensation is part of the claim, Adoo-Kissi-Debrah has emphasised that her primary goal is not financial: Vindication for Ella and promoting cleaner air. 10th CEEJH Environmental Justice Symposium: Environmental Justice Past, Present, and Future Environmental Justice, Goods Movement, and Air Quality Issues in New Jersey While transportation of goods in this country is pivotal for the economic and social well-being of the country, it has enormous carbon and air pollution footprints--these footprints differentially burden and impact communities of color and low-wealth areas. The Port of New York and New Jersey (PANYNJ) is the third largest seaport in the United States, comprising nearly 30% of the East Coast’s total port market share. 85% of goods leaving the port are transported by diesel-powered trucks via major highways and local roads within the region to nearby warehouses, assembly facilities, and retailers. This affects the health of the South Ward, Newark, New Jersey residents, which contains the predominantly African American neighborhoods of Dayton Street, Weequahic, and Clinton Hill. In this session, panelists will describe the established community-university-government partnership to understand exposure issues and cumulative impacts of goods movement activities and environmental injustice in the South Ward. Panelists will discuss the benefits of, lessons learned from, and challenges associated with developing a hyperlocal low-cost real-time PurpleAir monitoring network in the South Ward to measure baseline particulate matter levels. They will discuss findings from 2023-2024 and what this means for regulation and enforcement in the community. Furthermore, panelists will speak on the use of C-12 black carbon monitors, a community-friendly aethalometer-based instrument that can capture black carbon readings, further pinpointing soot and diesel exhaust coming from port-related traffic. Panelists will discuss community-centered strategies, recent cumulative impacts legislation, and solutions that should be implemented such as truck rerouting, zero emission zones, clean air zones and corridors for children, and truck idling enforcement.
