The law should be something that the average person can understand. When courts make rulings, the average person should pretty much be able to follow along and ultimately say, "Ok, that makes sense." But law does not want to be that way. Law, lawyers, courts -- the whole system is built on making law this complex, elaborate, opaque system that the average person cannot understand. The whole system is built on making law this complicated thing that is completely inaccessible. The system does that because of money and power. And for centuries, that worked. The internet changed everything. Courts were secret star chambers for centuries. Judges liked it that way. They issued their rulings. Their rulings were basically not available to regular people -- you had to go to a courthouse and get a paper copy. Judges loved that. They got to work in the dark. They were hidden. They were insulated. They could do whatever dirty, corrupt, unprincipled stuff they wanted to do. There was far less scrutiny of their opinions. The internet didn't exist. People at large couldn't discuss and debate their rulings. There were no online databases of their financial holdings or campaign donors. They loved that, too. Lots of them are angry about how technology and public access changed everything. Litigation was a largely secret process. There were no conversations about litigation and cases. Big companies and corporate lawyers loved that. Sure, there might be an occasional mention in the press. But it was largely static; not dynamic. There was no way for the people at large to share information about what corrupt companies and their corrupt lawyers were doing. Their legal machinations. Likewise, there was no way for regular people to share their story with other people at large. And that does two big things. (1) Public pressure. Think American Airlines and the "You knew we were recording you on the toilet and it was your fault" defense." No public forum, and that continues to happen. And (2) Witnesses. Companies are terrified of people like me going public because they know they are habitual bad actors --- and they know witnesses will come forward and reach out to me. Corrupt judges, corrupt companies, corrupt lawyers --- They all thrive in secrecy. And whatever may come to light, they want the law to be a bunch of mumbo jumbo and complex legalese. They want it to be inaccessible and incomprehensible to regular people. That way they can do whatever corrupt dirt they want to do -- and justify it by saying that you just don't understand. These bad actors are angry about the democratization of law and knowledge. They don't like regular people being able to read cases, understand the law, question their actions, advocate more effectively for themselves, alert the public, rally supporters, find witnesses... So they'll fight like mad to keep law secret and old timey--- but the genie is out of the bottle. And the next 10 years are going to be even better.
