Yesterday, IAB Europe, in coalition with national trade association members representing thousands of companies operating in the digital marketing and advertising ecosystem - Alliance Digitale, IAB Italia, IAB Polska, IAB Spain, IAB Sweden, SPIR & VIA Nederland - have responded to the EDPB public consultation on their draft guidelines 2/2023 on Technical Scope of Art. 5(3) of ePrivacy Directive. The undersigned associations have grave reservations that the proposed guidelines 2/2023 as currently drafted entail significant risks of discrepancies in their application by organisations and regulators, defeating thereof the purpose to remove ambiguities related to the material scope of Article 5(3) of the ePrivacy Directive.
