Day 28: Parts of Courtroom ⚖️ The High Courts are the 2nd top-rated ⬆️servers of Justice and work throughout the year 💪🏻 to provide for the people 👫and perform their liability. It isn't just the Judge who is solely helping to give Justice. The route to access the Courts and Judges 🧑🏻⚖️is also equivalent. The members that are constantly working in the Court are like the organs🫀🫁of the Court when stop working, would lead to the failure 😭 of justice. The role of the Courts rests on: 1. To promote justice in individual cases. 2. To ensure the public perceptions of justice in individual cases. 3. To provide an impartial forum for the resolution of legal disputes. 4. To protect individuals against the arbitrary use of governmental power. 5. To provide for a formal record of legal status and to deter criminals. 6. To rehabilitate individuals convicted of crime. 7. To provide for the separation of convicted individuals from society where necessary. All of these isn't just possible without the members and staff ⚕️ of the court that are: First is the General Office Cadre or the members of 1st class office members: * Registrar * Joint Registrar * Deputy Registrar * Assistant Registrar * Section Officer * Review Officer * Assistant Review Officer * Computer Assistant * Review Officer (Hindi/Urdu) Then are the 2nd rank office members: * P.S./A.P.S. Cadre—Private Secretary/Additional Private Secretary * B.S. Cadre—Bench Secretary * Computer Cadre—Computer Cadre (SM/SSA/SA/PG-I/PG-II/CO-C/CO-B) Then comes the 3rd class office members also called Misc. * Senior System Officer * System Officer * System Assistant * Telephone Operator * O.S.D.(Physiotherapist) * Chief Documentation * Officer-cum-Chief Librarian * Dy. Librarian And last comes the 4th rank office members: * Electrician * Helper * Jamadar * Peon Without these people the Court can't even move🏃🏻 a single bit and moreover it won't be able to work. "Apex Court of Our Country is on 7 weeks (approx. 50 days) long Summer Break" When I came across a heading like this in an article, my immediate response/thoughts that came into my mind : a) How can there be a 50 days long break allowed in a country and that too for the apex court of a country ? b) I do not consider the role of a judicial system less important than doctors and soldiers working round the clock for the country ? c) Is there is any other profession in the country where similar leaves are allowed ? d) In a country where the prime minister and president works round the clock, are these leaves still justified ? e) There is a huge backlog of pending cases (and still growing) before the courts. This is when, the court functioning time is 10 am to 04 pm normally and even on Saturday’s only limited matters are kept for hearing. On the contrary, there are also arguments to say : - Some of the important matters are still allowed to be heard during summer vacations - This is required to bring more intellectual efficiencies in the legal processes as sometimes judges work 7 days a week without taking leave of absence unlike legal counsels. - Reducing the summer vacations will not affect much in terms of reduction in the cases filed before courts The intent of these questions is neither to contempt courts or raising anything against law fraternity. But what I felt and is raised many a times by the retired judges and people with subject expertise-is a strong need of legal reforms -be it increasing the working hours of courts, opening new courts, appointing more judges, making the entire process paperless, changes in Indian Evidence Act and many more. باپ کی طرف سے بچوں کی interim maintenance ادا نہ کرنے کی صورت سپریم کورٹ نے باپ کو ایک لاکھ جرمانہ کردیا 2024 SCMR 1292 Interim maintenance --- Father failing to comply with order for payment of maintenance to the minors --- Contumacious conduct --- Costs , imposition of --- Family Court , in accordance with Section 17-A of the Family Courts Act , 1964 , had the lawful authority to strike off the defence of the petitioner ( father ) and decree the suit for maintenance on the basis of averments in the plaint and other supporting documents on record of the case , once the petitioner failed to pay the interim maintenance allowance by fourteenth day of each month during the pendency of proceedings --- Petitioner was also put to notice by the Family Court to clear the arrears of interim maintenance allowance otherwise the provisions of Section 17-A of the Act would be invoked , which the petitioner failed to comply with -- Moreover , the determination of the amount of maintenance by the Family Court was neither arbitrary nor capricious --- Hence , the High Court had rightly declined to interfere with the findings of the Family Court with regard to the quantum of maintenance allowance --- In view of the callous disregard of the petitioner for the court order to pay interim maintenance and his attempts to delay the payment of decreed maintenance allowance for his minor children , the Supreme Court imposed costs on the petitioner in the sum of Rs . 1,00,000 / - ( Rupees one hundred thousand only ) to deter such conduct in the future with the direction that the costs shall be recovered by the executing court as part of the decree for maintenance --- C.P.L.A.3155-L/2023 Shahzad Amir Farid v.
