Thrilled to share a favourable order from the Hon‘ble Madras High Court in a Trademark matter. The matter pertains to an appeal against the refusal of the mark INIMOX ( amoxycillin + cloxacillin injection for veterinary use) by the TMR following an opposition by proprietors of IMOX (amoxycillin tablets for humans). The Court held that INIMOX is liable to be registered and that there is no likelihood of deception or confusion, as long as INIMOX is not applied to products for humans. The Court delves into many important questions like- to what extent does the origin of a mark from a generic name impact its strength? Does the extent of impact depend on how much of the mark is appropriated from the generic name? How do you reconcile weakness of marks derived from a generic name or source with the vital need to protect the public from confusion and association in pharma goods?, amongst other questions. Some veterinary practice startups aren’t worried about hitting their required minimum spends. Maybe their forecasting is predicting they’ll blow past their spend requirements, even in an ADR economy. So why go through the effort to negotiate a custom contract with a lab vendor? Think of these lab contracts–if you’re even open to one at all–as a give-and-take (or preferably a strong win for the practice!). And think of the spend over the minimum requirements as options. These practices could decide to GIVE less to or GET more from lab vendors, depending on their priorities. GIVE less? Maybe these practices value their autonomy more than restrictive contracts (looking at you, in-house and reference lab exclusivity clauses 👀). Perhaps they would rather partner with other lab service providers for certain types of testing, or use multiple workflows or vendors within their practice. GET more? If your practice’s spend volumes are predicted to be way above the minimum requirements, what more could be available to you? Better pricing, rebates, or other perks? In either case, don’t waste the leverage you’re bringing to the table. CVS Group Plc (AIM:CVSG), the veterinary service provider, will be hoping the ongoing Competition and Markets Authority (CMA) probe into the industry doesn’t overshadow its trading update on Wednesday. Britain's competition authority said in September it is investigating “how veterinary services are bought and sold amid concerns that pet owners may not be getting a good deal”. Shares in #CVSGroup dropped close to 30% following the announcement and have struggled to rebound, lifting around 3% since. Nevertheless, like-for-like revenue growth is expected to comfortably meet targets of 4-7%, with analysts at Peel Hunt predicting £666 million in sales for the full year. Last year, the number of #vets employed by CVS rose by 6.5% and this trend has continued into the new financial year, offering up the chance for volume growth.
