Have you ever thought, "Man, the IRS is complicated?" 🤔 Well, this issue relating to your real estate status doesn't help the situation. 🏠 In fact, did you know that you can have both investor and dealer properties in your real estate portfolio? This is actually very important for tax purposes. Let me explain. 📝 Suppose you make a profit of $90,000 from a property sale. As a dealer, your tax could be up to $46,017, but as an investor, it might be only $21,420. That's a potential savings of $24,597 in taxes for investors! 💰 However, it's important to note that each property's classification is determined independently. When you look at every property individually to determine its classification, you need to make sure to identify each property as either an investment or dealer property in your records. Not doing so can lead to complications with the IRS. 😰 So, how do the courts determine your classification? The primary factor is your intention when purchasing and holding a property, and your records play a pivotal role in illustrating this intent. If you frequently buy and sell properties within a year, or if you purchase properties to renovate and sell, they're likely considered dealer properties. 🔧 On the other hand, if your goal with a property is appreciation or rental income, it's considered an investment property. Therefore, it's crucial to identify each property's classification correctly and make sure your records reflect your intention. Did you know that a 1031 exchange allows real estate investors to defer capital gains taxes when selling a property? We're getting ready to list an investment property on the lake in Johnson City. As usual, we ask the seller if he/she is considering a 1031 exchange for this property. This client said YES. So during this process, I'm going to be "journaling" the process for others to learn with us as we venture throughout the process. And I say "learn" because every transaction utilizing a 1031 exchange teaches me something or teaches me how to better serve my clients. Whether it's meeting a new CPA or Qualified Intermediary, getting a better understanding of the process, learning more about the tax code, or implementing improved systems, each transaction is different and an opportunity to learn. Together, by understanding 1031 exchanges, we'll learn more about this powerful tax-deferred strategy for investors. (I'm going to say this EVERY. SINGLE. TIME. ... As a real estate agent, while I can provide general insight into the concepts of a 1031 exchange, my client and I are (and always will) defer to the wisdom and advice of my client's CPA, Financial/Tax Advisor, and Qualified Intermediary and follow their instructions for compliant/legal/ethical utilization of a 1031 exchange. I play a small part in helping sell property #1 and locating and helping buy property #2, but it's the entire team that is crucial to this process.)
