Who is in charge of the Disney brand? Branding is everything we do, at every single touch point to confirm our promise as a brand. Disney’s promise - ‘magical experiences’ - could not be more at odds with all reported in this event. How is any of this increasing the trust we have in the brand? It doesn’t. And when we lack trust, the chemistry in our brains make it harder for us to take risks. Or, even further, makes us risk averse. Brands exist to serve customers, not to pay salaries. Accept that or start to see them walk out of the door. Yes, it is Disney, and people love it, and it will take some time for the whole thing to unfold, but it can happen. #brand #brandmanagement #branding

In a tragic case, Disney argues that a claim for wrongful death in the USA, should be dismissed in favour of arbitration, citing ‘terms of use’ agreed to when the claimant signed up for Disney+ in 2019. The arbitration clause, originally intended for the streaming service, is now being stretched to cover a fatal incident at Disney World. This raises serious questions about the scope of such clauses. Can a term agreed upon for a digital service really apply to an event of this magnitude? The outcome could set a precedent, potentially reshaping how companies draft their terms. This case is a stark reminder of the importance of reading the fine print and the potential power of arbitration clauses. This is one of the reasons why I want to make the law accesible to a not only to regular people, but also creatives. The more information one has, the more empowered one can be to make informed decisions. Electronic Terms and Conditions, from what I’ve learned in class, can sometimes be really tricky. Based on the information I’ve seen so far, it looks like the terms and conditions in this case were a part of a “click wrap agreement” (aka “click wrap”). 📋 “Click wrap”☑️: In these type of agreements, Company A is overtly asking Consumer to agree to a list of terms (usually has a hyperlink to the document embedded in the text). There is usually a check box that says “I agree to the terms and conditions” you have to click before you can finish an online purchase. Once Consumer checks that box, Consumer is telling Company A that he agrees to ALL of their terms and conditions, even if he didn’t read them. Yes, there is a “duty to read” (this just means its on the the party accepting the contract to read the contract before agreeing to it) here in the US; but Ms. Gilliam makes a good point: how does one expect an average consumer to read through 80+ pages of terms and conditions bogged down in language they won’t understand unless they Googled every other word? 🧐 I’m curious to see how this situation will play out because watching Disney+ and eating food at a theme park are two disjointed activities on there own that are connected by the product/service synergy of a specific brand. 🎢 We shall see🤗 #disney #law #contracts #food #amusementpark #accesibility
