The Hague Court of Arbitration for Aviation is generating increased interest as a sector specific forum that offers parties a confidential and efficient means of dispute resolution through tailor made rules for both arbitration and mediation. This panel was one of two during the Airline Economics week-long event in Dublin. It followed The Hague Court of Arbitration for Aviation's own sold-out inaugural conference in the Hague. #airlineeconomics #arbitration #mediation #disputeresolution #airlines #aircraftleasing
The latest posting in the News section of the APF Advisors website is a brief update on the participation by our Principal, Terence Black, on one of the panels held as part of the recent well-attended Airline Economics School of Aviation Finance & Leasing in Dublin. The packed room generated enough heat to compensate for the damp day outside and provided a great forum for a lively discussion among the panelists, Ana Urien, Donal H., and Lindsay Sampson Bishop skillfully moderated by Peter Morton. A key takeaway was that the appropriate choice of dispute resolution needs to be considered in more detail than is typically the case when contracts are negotiated. It also provided an explanation of the growing role that The Hague Court of Arbitration for Aviation can play in providing a sector specific forum for confidential and efficient resolution of disputes through both arbitration and mediation. #airlineeconomics #aircraftleasing #arbitration #mediation https://lnkd.in/g-sUafV4

Here's a thoughtful piece by my colleagues Clare Reeve Curatola and Sanjay Lohano explaining how legal professional privilege can benefit them in avoiding court proceedings - but warning about what to be careful about. Worth a read! #BCLP #privilege #settlement
Put your cards on the table! In FW Aviation (Holdings) 1 Limited v Vietjet Aviation Joint Stock Company [2024] EWHC 1823 (Comm), the High Court confirmed the strength of protection given to communications enjoying Without Prejudice Privilege (“WPP”). Commercial parties invariably and understandably want to explore options for settling but hesitate for fear of adverse inferences being drawn. WPP can be a powerful tool in this context. In light of this new judgment, my colleague Clare Reeve Curatola and I have written an article on the nature and scope of WPP, providing practical tips for those looking to rely on this privilege whilst negotiating the settlement of a dispute. #Litigation #DisputeResolution #Investigations #Regulation #ComplianceandAdvisory #WithoutPrejudice #WithoutPrejudicePrivilege #Forfeiture #RelieffromForfeiture #Waiver #LegalPrivilege https://lnkd.in/e9EmxVEe
