While many of you were sipping Piña Coladas on the beach, the agencies and courts were busy this summer! On September 7, 2023, Debra Dyleski-Najjar presented her monthly legal update to the Greater Merrimack Valley SHRM Chapter. Developments include impact of recent US Supreme Court cases on employer DEI programs, the DOL proposed rule increasing the “salary” threshold for exemption from overtime, a recent US District Court decision which may further limit applicability of the “Administrative Exemption”, update on the status the PFMLA top-off law in Massachusetts, proposed Pump Act Guidance and the EEOC proposed regulations implementing the Pregnant Worker Fairness Act, the beginning of “reverse discrimination” lawsuits, the new I-9 Form and E-verify, and developments at the NLRB impacting non-unionized workplaces. These developments warrant review, and probably an update, of employer policies, handbooks, job descriptions and agreements. HR professionals: Are you ready to implement all of the regulatory employment law updates that were announced last month? With so many new rules and guidance – and then the legal challenges trying to block them - it’s hard to keep up! There are a few FREE upcoming webinars to help you get ready. 🤰 The EEOC’s final rule implementing the Pregnant Workers Fairness Act (PWFA) will take effect on June 18. If you haven’t read through the 400+ pages of the rule and interpretive guidance, you may want to attend the EEOC’s free webinar on May 21. During this webinar, EEOC attorneys and staff will discuss workers' rights and employer responsibilities under the law and the EEOC's final regulation. Link to registration is in the comments. 💲The Department of Labor (“DOL”)’s final rule that raises the salary thresholds for certain exemptions to the overtime pay requirements of the FLSA will take effect on July 1. The DOL’s Wage and Hour Division will offer online seminars to provide a general overview of these updates. The first of two opportunities to attend these online seminars will take place on May 30. A registration link is in the comments. Keep in mind that these are just two new rules that were issued in April amongst other changes in the area of employment law. ⚖️ HR professionals should also be aware of the Federal Trade Commission’s noncompete clause rule which is set to take effect as of September 4, 2024 and ban most noncompetes. ⚖️ Finally, while it’s not a final Rule or new law, don’t forget to familiarize yourself with the EEOC’s April 29, 2024 Enforcement Guidance on Harassment in the Workplace.
