An old Palestinian woman, who has lived longer than the state of ‘Israel’ itself, watched as her home was bulldozed by foreigners who claim it as their own. The bulldozers destroyed not just her home but the history and memories of a family that likely lived there for generations. This woman’s experience is a reality for many, and all too often ignored by the global community. Her home, like many, was demolished on the pretext that she had no legal right to it, based on cunning legislation from the late 1940 to the late 1960s— namely: - The Absentees' Property Law (1950): This law was used to take control of land belonging to Palestinians who were massacred, or expelled during the 1948 Arab-Israeli War and were not present to claim their property. - Land Acquisition Laws (1953): These laws allowed the state to take control of lands for public purposes, which disproportionately affected many Palestinian-owned lands. - Post-1967 Legislation: After the 1967 War and the occupation of the West Bank and Gaza, military orders and regulations affected land registration and property rights in these territories, complicating the legal landscape further. These laws were essentially crafted to prevent Palestinians from registering their lands and homes, effectively leaving them without legal recourse and making their historical connections to the land invisible under ‘Israeli’ law. This isn't just one unfortunate event; it mirrors a larger scheme. While Palestinians are held to stringent standards requiring detailed paperwork, Jewish settlers are allowed to occupy Palestinian lands illegally, with little to no consequence. These settlements intentionally blur the lines of the 1967 borders, diminishing the chances for a two-state solution. The double standards are clear: demanding extensive documentation from Palestinians while ignoring international laws that condemn the illegal settlements. This ongoing injustice not only highlights the systemic bias against Palestinians but also hinders any progress toward a peaceful resolution.

Intervention. It’s a concept most lawyers learn about in law school but rarely encounter in practice. Here in the state AG world we deal with it regularly. Sometimes it’s deciding how to respond when another party tries to intervene in our case. Other times it’s making the decision that it’s in our state’s interest to intervene in someone else’s case. In either scenario, it involves making consequential decisions in a rapidly changing case. Our office recently filed motions to intervene in two related cases: East Bay Sanctuary Covenant v. What is 'Aboriginal title'? Ten years ago, in the groundbreaking Supreme Court case in BC, the Tsilhqot’in Nation successfully asserted Aboriginal title, and forced Canada’s courts to recognize this. Now, after 50 years, the Haida Nation is celebrating its Aboriginal title recognition. "This is the first time that governments will have negotiated, rather than being told by a court, after litigation, to recognize the existence of Aboriginal title. 📰ANALYSIS📰 here's my overview of the judgment in Smith v SSHD, in which parts of the Police Act 2022 were found to be incompatible with the rights of Gypsies, Roma and Travellers not to be discriminated against in the enjoyment of their right to private and family life. The crux: 📌 Where features of legislation make it harder for particular persons to comply with the law and in consequence expose them to the risk of prosecution, the legislation may be found to breach the state's human rights obligations; 📌 Here, the national shortage of authorised pitches for Gypsies, Roma and Travellers meant that banning them from returning to unauthorised sites for 12 months made it very difficult or impossible for them to comply with the law and avoid prosecution and seizure of caravans - ie. their homes; 📌 Resolving this incompatibility is likely to create some headaches for the government. Most likely, they either they address the national shortage of authorised pitches at considerable cost or they relax / abolish the string of 12 month 'no-returns' bans by amending the legislation and updating the statutory guidance. Credit to the claimant, her legal team, the interveners - Friends, Families and Travellers & Liberty (National Council for Civil Liberties) - a privilege to work together on this important case.
