Protecting trademarks and preserving freedom of expression can be a balancing act.
What happens when the First Amendment and trademark law conflict? This issue usually, but not always, arises when using marks for artistic purposes, such as in fine art, TV, film, commercials, etc. The SCOTUS previously created the “Rogers Test,” holding that a movie title will be protected unless it has no artistic relevance to the underlying work, or, if there is artistic relevance, the title explicitly misleads as to the source of the content of the work. This has become the seminal test for First Amendment v. Trademark Law cases, but it has been limited in recent years. #legalnews #trademarklaw #FirstAmendment #IPLawyers
