Attendance Note: Date: Wednesday 15th May, 2024 Client: Mr. A Advisor: Tim Cater (Supervising Solicitor Pro Bono) Facts of the case: • Mr. A is a consumer who purchased a faulty product from a local electronics store. • The product stopped working within a week of purchase and Mr. A tried to return it to the store for a refund or replacement. • The store refused to provide any remedy, claiming that the product was no longer under warranty. • Mr. A is seeking advice on his rights as a consumer and whether he can take legal action against the store. Advice provided: • Tim Cater advised Mr. A that under the Consumer Rights Act 2015, consumers have the right to return faulty goods and receive a refund, repair, or replacement. • He explained that the store’s refusal to provide a remedy may be a breach of consumer rights and suggested that Mr. A could consider sending a formal complaint to the store or seeking legal advice to explore his options further. • Tim Cater also highlighted the importance of keeping records of all communication with the store and any evidence of the faulty product. Overall, the session was informative and Mr. A left with a better understanding of his consumer rights and potential next steps to take in resolving the issue with the store. Note: for client confidentiality, I have made some adjustments to the facts. This was a Pro Bono activity organized by The University of Law.

In the recent LIDL case, the Company Names Tribunal (CNT) ruled against another company from using "LIDL" as part of its corporate name, despite being incorporated in 2004 and never engaging in trade. The High Court, echoing the CNT, gave priority to senior right holders. The owner's statement expressing no intent to trade in the future played a pivotal role in the HC's decision. However, a key question emerges: Would the High Court's decision have swayed if the owner had communicated an intention to pursue a trade entirely distinct from Lidl's?
